body
BACKGROUND

This item authorizes the second step of acquisition for condemnation by eminent domain to acquire a wastewater easement from Keller Springs Estates, Ltd., of approximately 43,509 square feet of land, located near the intersection of Keller Springs and Preston Roads for the McKamy and Osage Branch Wastewater Interceptor Project. The property owner has declined the City's offer and has countered at an amount significantly higher than the appraised value, the City will not be able to close the transaction amicably.

The first resolution approved on June 26, 2019, by Resolution No. 19-0991, authorized the purchase in the amount of $233,942.00.

This property will be used for the improvements and relocation of the McKamy and Osage Branch wastewater line. The consideration is based on an independent appraisal. There are no relocation benefits associated.
