BACKGROUND
This item grants a private license to, KBSIII Preston Commons, LLC, for the use of approximately 820 square feet of land to maintain and utilize a subsurface grease trap under a portion of Weldon Howell Parkway right-of-way located near its intersection with Preston Road. The use of this area will not impede pedestrian or vehicular traffic. The term of this license is forty years.
The licensee will indemnify the City and carry general liability insurance naming the City as an additional insured.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 12, 2010, the City Council authorized a revocable license to Milan Ventures, Inc. for the purpose of occupying, maintaining and utilizing a subsurface grease trap on a portion of Weldon Howell Parkway right-of-way by Resolution No.10-1227; Ordinance No. 27868. The term of this license was five years.
On April 25, 2018, the City Council authorized renewal of a revocable license to Milan Ventures, Inc. for the purpose of occupying, maintaining and utilizing a subsurface grease trap on a portion of Weldon Howell Parkway right-of-way by Resolution No.18-0605; Ordinance No. 30841. The term of this license was three years.
