BACKGROUND
This action will authorize a three-year use agreement, with two ten-year renewal periods with White Rock Boathouse Inc. (WRBI) to manage and maintain the existing Boomerang, previously known as the White Rock Boat House, which is critical to store launch and safety boats for the White Rock Rowing Program. WRBI will pay a minimum of $1,350.00 annually to the City of Dallas Park & Recreation Department (CODPARD).
On November 19, 2003, the City entered into a ten-year agreement with two five-year renewals, with White Rock Boathouse, inc. to renovate, operate and maintain the existing White Rock Boat House, which includes slips, moorings, docks and storage facilities by Resolution No. 03-1530. White Rock Boathouse Inc. is a Texas non-profit organization formed to provide rowing opportunities for youth athletes and adults at White Rock Lake.
On November 6, 2018, the parties entered into a Supplemental Agreement to amend Section 5, Compensation to City, which increased the percentage of gross receipts by Licensee from five percent to 10 percent, by Administrative Action No.18-6889.
WRBI currently has an agreement with the CODPARD to manage and operate the Boathouse and the Filter Building at White Rock Lake. WRBI uses this multi-purpose facility for events and various training activities and rowing programs. Both agreements are necessary to WRBI for a successful rowing program.
Obligations of the City include the following:
1. City reserves the right to enter and inspect the premises during normal business hours.
Obligations of White Rock Boathouse Inc. include the following:
1. Annual payment of a minimum of 10 percent of gross receipts from rowing and related activities, but no less than $1,350.00 per year. Total estimated financial commitment of $31,050.00.
2. Be solely responsible for maintenance of the premises.
3. Be responsible for furnishing all equipment for the proper operation of the premises as a rowing facility.
4. Be responsible for payment of all utilities.
5. Provide annual financial statements of revenues generated provided by a certified public accountant.
6. WRBI may renew, provided that they are not in default, by providing written notice to the City at least six months, but not later than twelve months prior to the termination.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 18, 2023, the Park and Recreation Board authorized a three-year use agreement with two ten-year renewal periods with White Rock Boathouse Inc.
