Title
Authorize the (1) acceptance of a grant from the U.S. Department of Transportation Federal Highway Administration through the Texas Department of Transportation (TxDOT) for the Surface Transportation Block Grant (STBG) Program (Agreement No. CSJ 0918-47-352, Assistance Listing No. 20.205) in the amount of $1,200,000.00 as federal participation in the total project cost of $1,607,763.00, which includes $1,176,000.00 in federal reimbursement, $24,000.00 as federal participation for direct state cost, $77,763.00 as state participation for indirect state cost, and $330,000.00 ($294,000.00 for construction and $36,000.00 for direct state cost paid to TxDOT prior to construction) as local participation plus any cost overruns for the construction of a 0 to 4 lane roadway on Copenhagen Avenue from East Belt Line Road to south of Dallas Area Rapid Transit’s (DART) right-of-way in the city of Dallas; (2) establishment of appropriations in the amount of $1,176,000.00 in the TxDOT STBG Copenhagen Ave: E. Belt Line to S. DART ROW Fund; (3) receipt and deposit of funds in the amount of $1,176,000.00 in the TxDOT STBG Copenhagen Ave: E. Belt Line to S. DART ROW Fund; (4) required local match in the amount of $330,000.00; and (5) execution of the Advance Funding Agreement with TxDOT and all terms, conditions, and documents required by the agreement - Total amount of $1,506,000.00 - Financing: TxDOT STBG Copenhagen Ave: E. Belt Line to S. DART ROW Fund ($1,176,000.00) and DART Transportation Projects Fund ($330,000.00)

BACKGROUND
On September 12, 2024, the Regional Transportation Council (RTC) of the North Central Texas Council of Governments approved the allocation of federal funding to construct a segment of the new four-lane roadway identified as Copenhagen Avenue extending from East Belt Line Road to south of the Dallas Area Rapid Transit (DART) right-of-way in the City of Dallas (“Project”).
On January 22, 2025, the City Council authorized the Notice of Intent to establish Quiet Zones along DART’s Silver Line corridor encompassing 11 railroad crossings, which included a crossing at the future Copenhagen Avenue in the Cypress Waters Development by Resolution No. 25-0208. The City Council subsequently authorized the Notice of Establishment for the same Quiet Zones on April 23, 2025, by Resolution No. 25-0641.
The City of Dallas desires to enter into an Advance Funding Agreement (AFA) with TxDOT to accept federal funding through the Surface Transportation Block Grant (STBG) Program for construction of the Project. The future Copenhagen Avenue will cross the DART Silver Line rail line leading into the Cypress Waters Station and will support the establishment of the Quiet Zones in this area.
The Texas Transportation Commission passed Minute Order No. 116752 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as the construction of new roadway lanes, which included this Project.
TxDOT is contributing $1,176,000.00 in federal reimbursement, $24,000.00 as federal participation for direct state cost, and $77,763.00 as state participation for indirect state cost. The City’s participation is $330,000.00, which includes $294,000.00 for construction and $36,000.00 paid to TxDOT prior to construction for direct state cost. The total estimated cost is $1,607,763.00.
The City is the lead agency to administer the construction of the Project pursuant to the terms of the AFA. The City is also responsible for any cost overruns that exceed federal and state funding participation.
Billingsley D&D, Inc., a private developer, has agreed to develop the full schematic design and the detailed design plans for the segment of the roadway at the DART Silver Line rail crossing, at its sole expense, and donate the plans to the City for construction of the Project. The detailed design is valued at $1,500,000.00 and covers the segment of Copenhagen Avenue from East Belt Line Road to south of DART’s right-of-way (this Project). The full schematic design will cover the roadway from East Belt Line Road to Olympus Boulevard. An agreement formalizing the donation is included on this City Council agenda for consideration.
A contract for the construction and completion of the Project will be placed on a future City Council agenda for consideration.
This action will authorize an AFA with TxDOT for construction of the project and local participation in the amount of $330,000.00 of which $36,000.00 will be paid to TxDOT for direct state cost prior to construction.
