BACKGROUND

 

On August 12, 2020, the City of Dallas entered into an Advance Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) in the amount of $4,000,000.00 for design and construction of a twelve-foot-wide trail from the LBJ/Skillman DART Station to the Richardson City Limits at Buckingham Road using property owned by the Kansas City Southern Railway Company (KCS). The project was funded completely with federal sources, through Congestion Mitigation and Air Quality Program funding from the North Central Texas Council of Governments and the use of Transportation Development Credits, in the amount of $800,000.00, to serve as the required local match.

 

Since the agreement award date, it has been determined through conversations with KCS that a multi-use trail will not be allowed within their rail right of way. With the project no longer being feasible, it is necessary to terminate the Agreement with TxDOT.

 

This action will authorize the execution of Amendment No. 1 to the AFA (Agreement No. CSJ No. 0918-47-273) with TxDOT to terminate the executed agreement for the for design and construction of a twelve-foot-wide trail from the LBJ/Skillman DART Station to the Richardson City Limits at Buckingham Road using property owned by the Kansas City Southern Railway Company (KCS).

 

 

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On August 6, 2020, the Park and Recreation Board authorized the Advance Funding Agreement with the Texas Department of Transportation for a Congestion Mitigation and Air Quality Improvement Program Project (Agreement No. CSJ: 0918-47-273) for design and construction of the KCS Trail.

 

On August 12, 2020, the City Council authorized the Advance Funding Agreement with the Texas Department of Transportation for a Congestion Mitigation and Air Quality Improvement Program Project (Agreement No. CSJ: 0918-47-273) for design and construction of the KCS Trail by Resolution No. 20-1171.

 

On September 25, 2025, the Park and Recreation Board authorized Amendment No. 1 to terminate the Advance Funding Agreement authorized by Resolution No. 20-1171, previously approved on August 12, 2020, with the Texas Department of Transportation and execution of the Amendment and all terms, conditions, and documents required by the Advanced Funding Agreement (Agreement No. CSJ No. 0918-47-273).
