Body
BACKGROUND
On September 22, 2021, the City Council authorized a construction services contract with DDM Construction Corporation for the construction of CBD Fair Park Link from Hall Street to Main Street by Resolution No. 21-1522.
On June 16, 2022, Dallas Area Rapid Transit (DART) notified the City that construction activities within the DART railroad crossing could not proceed until a Preliminary Hazard Analysis (PHA) was completed and approved in accordance with updated federal railroad safety requirements. Although DART had approved the original construction plans on February 23, 2018, the revised federal requirements necessitated additional safety analyses and design modifications before work could continue within DART right-of-way.
As a result, after all work outside the DART right-of-way had been completed, construction activities were suspended on March 17, 2023. Upon completion of the PHA study, required design revisions, and DART's review, DART issued a No-Objection Letter on May 16, 2025, allowing the resumption of construction activities within its right-of-way.
During the extended construction suspension period, inflation and escalation in material and labor costs significantly increased the cost of completing the remaining work such that some remaining work items cannot be completed at the original contract unit bid price. Consequently, adjustments to the unit prices of these work items to reflect current prices are necessary.
The CBD Fair Park Link project cannot be completed until the DART crossing improvements are constructed and operational. Until this work is complete, pedestrians and bicyclists are unable to safely cross the DART tracks at Elm Street, leaving an incomplete transportation corridor and preventing the project from achieving its intended safety improvements. Completion of the CBD Fair Park Link project is necessary to provide a safe, accessible, and Americans with Disabilities Act (ADA)-compliant corridor consistent with the City's Vision Zero goals.
This action will authorize Change Order No. 6 to the construction services contract with DDM Construction Corporation to (1) provide additional work items needed to complete the construction of the CBD Fair Park Link from Hall Street to Main Street; and (2) extend the contract term by two hundred forty calendar days, from May 5, 2027 to December 31, 2027, in an amount not to exceed $2,214,096.23, increasing the contract amount from $5,937,904.87 to $8,152,001.10.
