Title
Authorize (1) the acceptance of a grant from the U.S. Department of Transportation Federal Highway Administration through the Texas Department of Transportation (TxDOT) for the Surface Transportation Block Grant (STBG) Program (Agreement No. CSJ 0918-00-472, Assistance Listing No. 20.205) in the amount of $495,000.00 as Federal participation in the total project cost of $520,400.00, which includes $480,150.00 in Federal reimbursement, $14,850.00 as Federal participation for direct state cost, $25,400.00 as State participation for indirect state cost, and the use of 99,000 City of Irving Transportation Development Credits plus any cost overruns as local participation for environmental assessment and mitigation, architectural and engineering, and construction of a right turn/declaration lane to improve safety on Belt Line Road at South Northlake Road in the City of Dallas; (2) the establishment of appropriations in the amount of $480,150.00 in the TxDOT STBG Program - Belt Line at South Northlake Road Fund; (3) the receipt and deposit of funds in the amount of $480,150.00 in the TxDOT STBG Program - Belt Line at South Northlake Road Fund; and (4) execution of the Advance Funding Agreement with TxDOT and all terms, conditions, and documents required by the agreement - Total amount of $480,150.00 - Financing: TxDOT STBG Program - Belt Line at South Northlake Road Fund

BACKGROUND
On February 8, 2024, the North Central Texas Council of Governments’ Regional Transportation Council authorized federal funding for engineering and construction of a right turn/declaration lane to improve safety on Belt Line Road at South Northlake Road (“Project”). The project limits lie within the corporate boundaries of the City of Dallas and the City of Irving, which will require collaboration between the two municipalities to complete the Project. The City of Irving is providing 99,000 Transportation Development Credits (“TDCs”) to serve as local participation on the Project. An interlocal agreement with the City of Irving outlining the terms for this joint project is included on this City Council Agenda for consideration.
The Texas Transportation Commission passed Minute Order No. 116752 authorizing the State to undertake and complete a highway improvement or other transportation project generally described as transportation non-roadway, which included this Project.
The City of Dallas desires to enter into an Advance Funding Agreement (AFA) with TxDOT to accept federal funding through the STBG Program for engineering and construction of the Project.
The City of Dallas is the lead agency to administer the environmental assessment and mitigation, architectural and engineering, and construction of the Project pursuant to the terms of the AFA.
The total estimated project cost is $520,400.00, which includes $480,150.00 in Federal reimbursement, $14,850.00 as Federal participation for direct state cost, $25,400.00 as State participation for indirect state cost, and the use of 99,000 City of Irving TDCs will serve as local participation. The City of Dallas is responsible for any cost overruns that exceed federal and state funding participation.
TDCs are a financial accounting tool approved by the Federal Highway Administration. These credits are non-cash credits allocated to States as a representative value to account for toll road and tolled managed lanes that benefit the federal system.
This action will authorize an AFA with TxDOT for engineering and construction of the Project utilizing a combination of federal funding and TDCs.
