Title
Authorize (1) an increase to the construction services contract with Vescorp Construction, LLC dba Chavez Concrete Cutting in an amount not to exceed $699,815.26 and to extend the contract for an additional twelve months from June 1, 2025 to June 1, 2026 for additional sidewalk improvements, for the Alley Trail Conversion at various alley locations and for the sidewalk improvements on McKinney Avenue from Maple Avenue to Allen Street; and (2) the restoration of funds in an amount not to exceed $3,031,696.07 from Change Order No. 2, approved by Resolution No. 24-0551, on April 10, 2024 for additional sidewalk improvements needed to the 2022 Dallas Sidewalk Master Plan Improvements Contract at various locations throughout the City - Total Nnot to exceed $3,731,511.33, from $10,855,453.93 to $14,586,965.26 - Financing: General Fund ($1,797,788.35), 2024 Certificate of Obligation Fund ($1,233,722.98), and 2024B Certificates of Obligation Fund ($700,000.00)

BACKGROUND
The Dallas Sidewalk Master Plan, completed in June 2021, is a targeted path forward that is aimed at improving pedestrian mobility. This work utilized a data-driven methodology system to identify the most impactful projects to increase accessibility for pedestrians, improve safety for all City residents, and address sidewalk needs in historically underserved communities.
On May 25, 2022, the City Council approved authorized a thirty-six-month contract with Vescorp Construction, LLC dba Chavez Concrete Cutting for the 2022 Dallas Sidewalk Master Plan Improvements that includes water and wastewater adjustments at various locations throughout the City, in an amount not to exceed $13,887,150.00, by Resolution No. 22-0794.
On January 25, 2023, the City Council approved authorized Change Order No. 1 to the construction services contract with Vescorp Construction, LLC dba Chavez Concrete Cutting to implement an Alley Trail Conversion Program on a select group of alleys in various locations to authorize reducing Street and Alley Improvements Fund capacity by $3,031,696.07 and replace with CSLFR and CDBG Funds for a zero-dollar change order, keeping the contract amount at $13,887,150.00, by Resolution No. 23-0176.
On April 10, 2024, the City Council approved authorized Change Order No. 2 to authorize a decrease in the construction services contract with Vescorp Construction, LLC dba Chavez Concrete Cutting by reducing the funding from the Coronavirus State and Local Fiscal Recovery Funds and Community Development Block Grant Funds capacity, in an amount not to exceed ($3,031,696.07), decreasing the contract amount at $13,887,150.00 to $10,855,453.93, by Resolution No. 24-0551.
Projects being implemented with this contract include priority projects identified in the Dallas Sidewalk Master Plan’s 12 Focus Areas, the Alley Trail Conversion Project to install decomposed granite trails in alleys at various locations, and sidewalk improvements on McKinney Ave from Maple Avenue to Allen Street. These projects will be constructed with 2024 Certificates of Obligation Funds, 2024B Certificates of Obligation Funds and General Funds.

This action will authorize Change Order No. 3 to increase the construction services contract with Vescorp Construction, LLC dba Chavez Concrete Cutting, extending the contract term by twelve months and increase the quantity of various bid items on the 2022 Dallas Sidewalk Master Plan Improvements Contract for additional sidewalk construction, for the Alley Trail Conversion at various alley locations and for the sidewalk improvements on McKinney Avenue from Maple Avenue to Allen Street.

On April 10, 2024, the City Council authorized Change Order No. 2 to the construction services contract with Vescorp Construction, LLC dba Chavez Concrete Cutting to deduct the Development the Federal and Community Development Block Grant Funds due to the Federal and Community Development Block Grant required provisions absent in the 2022 Dallas Sidewalk Master Plan Improvements Contract by Resolution No. 24-0551.
