Body

BACKGROUND

On August 30, 2022, the Texas Transportation Commission passed Minute Order No. 116292, authorizing the State to undertake and complete a highway improvement or other transportation project generally described as design and construct 22 signals in the area damaged by 2019 tornado, which included this project.

On April 12, 2023, the City of Dallas entered into an Advance Funding Agreement (AFA) with TxDOT for the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (Agreement No. CSJ No. 0918-47-392 and 393, CFDA No. 20.205) in the amount of $14,300,000.00 as federal share in the total project cost of $17,200,791.09 (Federal share $14,300,000.00, Indirect State Costs $778,291.09, and City of Dallas participation $2,122,500.00 of which $21,225.00 is to be paid to TxDOT for initial costs prior to construction and includes the use of 1,162,000 Transportation Development Credits for a portion of the local cash match) for costs related to the design and construction of 22 signals in the area damaged by the 2019 tornado; and 9 signals along Hampton Road; and 13 signals along Lancaster Road, as shown on the Map, with all signal work including signal retiming by Resolution No. 23-0460. Since that time, it became necessary to break the 44 signals into three groups and amend federal funding allocation.

On April 23, 2024, the North Central Texas Council of Governments (NCTCOG) approved the split of the project into three groups and transferred the funding to the three new projects as approved in the 2023-26 Transportation Improvement Program (TIP) and Statewide Transportation Improvement Program (STIP).

The changes included: removing engineering funding; increasing construction funding; and changing the funding source from Congestion Mitigation and Air Quality Improvement Program (CMAQ)/Surface Transportation Block Grant Program (STBG) Funds to Regional Toll Revenue (RTR) Funds. Additionally, Transportation Development Credits (“TDCs”) will not be used as local match for these projects as previously approved under the single AFA.

Future City Council agenda items will be needed for the approval of the new AFA’s.

This action will authorize execution of Amendment No. 1 to the AFA with the TxDOT to terminate the executed agreement for the acceptance of the grant from the United States Department of Transportation Federal Highway Administration through TxDOT for the CMAQ (Agreement No. CSJ No. 0918-47-392 and 393, Assistance Listing No. 20.205).
