Authorize the second step of acquisition for condemnation by eminent domain to acquire from AT&T INC., formerly known as Southwestern Bell Telephone Company of approximately 52,059 square feet of land located near the intersection of Lombardy Lane and Brockbank Drive for the Fire Station No. 43 Replacement Project - Not to exceed $1,109,060.00 ($1,100,000.00, plus closing cost and title expenses not to exceed $9,060.00) - Financing: Public Safety (G) Funds

BACKGROUND
This item authorizes the second step of acquisition for condemnation by eminent domain to acquire from AT&T INC., formerly known as Southwestern Bell Telephone Company of approximately 52,059 square feet of land located near the intersection of Lombardy Lane and Brockbank Drive for the Fire Station No. 43 Replacement Project. An offer was presented to the property owner on December 6, 2024 reflecting the appraised value and the City’s offer was declined. Negotiations between the City and the property owner have been ongoing and no amicable agreement has been reached.
The first resolution approved on March 26, 2025, by Resolution No. 25-0452, authorized the purchase in the amount of $1,100,000.00. This property will be used for the construction, use and maintenance of a replacement site for Fire Station No. 43.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On March 26, 225, the City Council authorized acquisition from AT&T Inc., of approximately 52,059 square feet of land located near the intersection Lombardy Lane and Brockbank Drive for the Fire Station No. 43 Replacement Project by Resolution No. 25-0452.
