Authorize an amendment to Resolution No. 22-0798, previously approved on May 25, 2022, for an Advance Funding Agreement with the Texas Department of Transportation (TxDOT) for a Transportation Alternatives Set-Aside (TASA) Program Grant (Agreement No. CSJ 0918-47-327, Assistance Listing No. 20.205) for costs related to the reconstruction and widening of the existing sidewalks to install Americans with Disabilities Act ramps, from Gaston Avenue to the Northwest, and North Prairie Avenue to the Northeast for installation of traffic calming improvements for crosswalks, signs, pedestrian signals and other Safe Routes To School Improvements, to correct the amounts in Sections 2, 3, and 4 of Resolution No. 22-0798 that were authorized for appropriations, receipt and deposit, and disbursement of funds from $325,661.00 to $296,056.00 - Not to exceed $296,056.00 - Financing: Texas Department of Transportation Grant Funds (see Fiscal Information)

BACKGROUND
On September 22, 2021, the City Council authorized a professional engineering services contract with Criado & Associates, Inc. for engineering services to design a shared use path along Elam Road between Pemberton Road and North Jim Miller Road and to design pedestrian improvements near the Ignacio Zaragoza Elementary School, in an amount not to exceed $433,735.00, by Resolution No. 21-1540.
On May 25, 2022, City Council authorized an Advance Funding Agreement with Texas Department of Transportation (TxDOT) for a Transportation Alternatives Set-Aside (TASA) Program Grant (Agreement No. CSJ 0918-47-327, CFDA No. 20.205) in the amount of $325,661.00 as federal share in the total project cost of $342,743.37 (Federal share $325,661.00, Indirect State $14,121.87, and City of Dallas match for Direct State Participation $2,960.50 totaling $342,743.37) for costs related to the reconstruction and widening of the existing sidewalks to install ADA ramps, from Gaston Avenue to the Northwest, and North Prairie Avenue to the Northeast for installation of traffic calming improvements for crosswalks, signs, pedestrian signals and other Safe Routes to School (SRTS) Improvements, provide actual cost overruns from the General Fund; and execute an Advanced Funding Agreement with TxDOT, and all terms, conditions, and documents required by the agreement, by Resolution No. 22-0798.
Direct State Costs in the amount of $29,605.00, which are funds paid to TxDOT from the Federal Highway Administration as part of the total grant amount, were not accounted for when determining the total grant funds being awarded to the City for the Elam SRTS project. The total grant funds awarded to the City should have been $296,056.00 instead of $325,661.00 as previously authorized by Resolution No. 22-0798. As such, the dollar amounts in Sections 2, 3, and 4 of Resolution No. 22-0798 that were authorized for appropriations, receipt and deposit, and disbursement should have been $296,056.00 instead of $325,661.00.
This action will amend the amount in Sections 2, 3, and 4 of Resolution No. 22-0798 that was authorized for appropriations

On December 11, 2024, the City Council authorized a construction services contract for the Zaragoza Elementary Safe Routes to School (SRTS) Pedestrian and Paving Improvements (CSJ 0918-47-327) Project to construct bicycle and pedestrian improvements near Ignacio Zaragoza Elementary School, bounded by Gaston Avenue to the northwest, North Prairie Avenue to the northeast, Main Street/Columbia Avenue to the southeast, and Alcalde Street to the southwest - Palmer Hall Evacuation and Utilities, LLC d/b/a Palmer Hall Construction, lowest responsible bidder of three, in the amount of $409,235.00, by Resolution No. 24-1777.

The costs associated with this project were originally authorized in the previous Council Resolution No. 22-0798; and the reduction in the Grant Award amount to the City does not affect this Advance Funding Agreement (AFA). This is correcting an error in the interpretation of the AFA on the part of the City, to correctly report the allocation of federal funds.
