Authorize Amendment No. 1 to the Advance Funding Agreement (Agreement No. CSJ 0581-01-157, Assistance Listing No. 20.205) between the City of Dallas and the Texas Department of Transportation for preliminary engineering, utilities, environmental, final engineering/design, plans, specifications, and estimates, and construction of intersection improvements including regrading, repaving, and sidewalks at Carbondale Street and Great Trinity Forest Way to revise the project funding participation by reallocating funding from the construction phase to the engineering phase - Financing: No cost consideration to the City

BACKGROUND
The City of Dallas and the Texas Department of Transportation (TxDOT) executed a contract on July 7, 2021, to effectuate their agreement to conduct preliminary engineering, utilities, environmental, final engineering/design, plans, specifications, and estimates, and construction of intersection improvements including regrading, repaving, and sidewalks at Carbondale Street and Great Trinity Forest Way in the city of Dallas.
It has become necessary to amend the agreement in order to revise the project funding participation by reallocating funding from the construction phase to the engineering phase.
If approved, this action will authorize an amendment to the agreement to reflect the following changes:
Attachment C, Project Budget, is deleted in its entirety and replaced with Attachment C-1, Project Budget, which is attached to and made a part of this Amendment. The total estimated cost of the Project amount did not change. The fund reallocation was requested by the City of Dallas due to the increases in engineering costs based on recent project cost analysis.
All other provisions of the original contract are unchanged and remain in full force and effect.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On January 13, 2021, the City Council authorized an Advance Funding Agreement with TxDOT to accept a federal Congestion Mitigation and Air Quality Improvement Program grant (Agreement No. CSJ 0581-01-157, CFDA No. 20.205) in the amount of $1,212,500.00 as federal and state share in the total project engineering cost of $1,304,805.00 (includes $1,212,500.00 in Federal and State reimbursement, direct state cost of $37,500.00, and indirect state $54,805.00 participation) for cost related to the preparation of preliminary engineering (design schematic, environmental documents/public involvement), plans, specifications and estimates to allow for the construction of intersection improvements including regrading, repaving, and sidewalks at Carbondale Street and Great Trinity Forest Way in the city of Dallas by Resolution No. 21-0132.
On April 13, 2022, the City Council authorized a professional services contract with Criado & Associates, Inc., to provide engineering services for development of schematics and design plans, and associated design elements for the project known as “Joppa Neighborhood Pedestrian Improvements” to include a pedestrian bridge over Union Pacific Railroad’s Dallas Yard Rail Line along Linfield Road, pedestrian access upgrades along Carbondale Street (CSJ 0918-47-310), and intersection improvements at Carbondale Street and Great Trinity Forest Way (Loop 12) (CSJ 0581-01-157) by Resolution No. 22-0552.
