Authorize Supplemental Agreement No. 2 to the professional services contract with Gresham Smith, for additional engineering services associated with the Lower East Bank Interceptor - Not to exceed $1,537,899.00, from $2,527,984.50 to $4,065,883.50 - Financing: Wastewater Capital Improvement G Fund

BACKGROUND
On December 14, 2016, the City Council awarded a professional services contract to Gresham Smith for the engineering design and surveying of an estimated 36,138 feet of water and wastewater main replacements at 13 locations. One of those locations included the replacement and rehabilitation of the existing Lower East Bank wastewater interceptor system that is in poor structural condition and needs additional capacity to support ongoing and future development. The Lower East Bank Interceptor has been identified in master planning efforts as one of Dallas Water Utilities’ Department (DWU) most critical pipeline improvement projects.
Following the completion of design and prior to the advertisement for construction bids, DWU completed an updated master plan that recommended an increase to the wastewater flows to be conveyed by the Lower East Bank Interceptor. The increased flows required the Lower East Bank Interceptor design to be modified before advertising for construction bids. On September 23, 2020, a construction contract was awarded and following award of the contract it was determined that the bottom of an existing pressure storm sewer conflicted with the proposed alignment of the interceptor. The existing pressure sewer has a bottom elevation different than what was originally anticipated based on the best available records and a portion of the interceptor design was modified to clear the conflict.
On November 9, 2022, the City Council authorized Supplemental Agreement No. 1 to the professional services contract with Gresham Smith, for additional engineering services necessary to complete the Lower East Bank Interceptor Project. Supplemental Agreement No. 1 funded the previous design modifications and allowed for the remaining funds to be used for construction phase services. During construction, several utility conflicts and constructability issues were encountered. Despite efforts to clear these conflicts and issues it was determined that the scope of the construction contract would need to be reduced and that additional engineering services need to be completed. Following completion of these additional engineering services, DWU will repackage the remaining work not completed by the original construction contract and advertise for new construction bids.
This action will authorize Supplemental Agreement No. 2 to the professional services contract with Gresham Smith for additional engineering services necessary to revise the design and repackage the remaining work for construction. The additional services include geotechnical explorations and evaluations, a Geotechnical Baseline Report, updating the design based on the new geotechnical information, environmental services, procuring the remaining construction work using Competitive Sealed Proposals, and additional construction phase services.

On December 14, 2016, the City Council authorized engineering services contracts with four consulting firms to provide design services for the replacement and rehabilitation of water and wastewater mains at 109 locations - Huitt-Zollars, Inc., APM & Associates, Inc., Gresham Smith and Partners, and Burgess & Niple, Inc., by Resolution No. 16-1946.
On November 9, 2022, the City Council authorized Supplemental Agreement No. 1 to the professional services contract with Gresham Smith to provide additional engineering services for the Lower East Bank Interceptor, by Resolution No. 22-1700.
