BACKGROUND

 

On January 7, 2022, TxDOT received bids to construct the Woodall Rodgers Freeway deck plaza structure extension (the “Project”) on-system improvements. However, the Project was paused to value engineer and to secure additional funding as a result of significantly higher bid costs than anticipated, and such additional funding includes $20,000,000.00 in Federal Reconnecting Cities Funds, $6,500,000.00 in 2024 Bond Funds (Proposition B), $1,350,900.00 ($1,300,900.00 available for construction costs) from Dallas County in accordance with the Project Specific Agreement with Dallas County, and in October 2021, an additional $6,800,000.00 in Surface Transportation Block Grant (STBG) was awarded by NCTCOG/RTC, making the total STBG Funds dedicated for the Project $36,800,000.00. An additional $7,848,437.00 of STBG Funds are anticipated for the Project, which includes $1,396,408.00 in traffic signal funding previously approved for the Project by the RTC on March 13, 2025. The City’s match of $349,102.00 is included as Local Participation.

 

In addition, on June 20, 2025, the Texas Transportation Commission unanimously approved WRPF’s State Infrastructure Bank (SIB) loan application making available $21,350,000.00 for construction of the deck structures over Spur 366 (Woodall Rodgers Freeway), with pledged collateral from special assessment revenue from the Klyde Warren Park/Dallas Arts District Public Improvement District, by Minute Order 116959. Private sector donations from WRPF in the amount of $7,500,090.00 complete the sources of funds to construct the TxDOT Project.

 

This action authorizes the City Manager to execute Amendment No. 1 to the on-system AFA to reflect updates in the Project budget and funding participation. No new City funding is being requested as part of this City Council action. The amended AFA increases the Federal Participation from $36,800,000.00 to $64,648,437.00 and the Local Participation (City of Dallas, Dallas County and Woodall Rodgers Park Foundation (WRPF) from $19,840,000.00 to $57,735,551.00, of which $46,600,092.00 shall be advanced to TxDOT prior to their bid letting of the Project ($11,135,459.00 of the project costs are direct pay professional fees funded by WRPF and not advanced to TxDOT). The Local Participation includes the City’s 2017 and 2024 Proposition B bond funds in the total amount of $16,100,000.00, City funding of previously approved traffic signals for the Project in the amount of $349,102.00, Dallas County funds in the amount of $1,300,900.00, and WRPF funds in the amount of $28,850,090.00. WRPF will fund and construct Klyde Warren Park 2.0 upon completion of the deck structure.

 

The amount accounted for in this item due to TxDOT to fulfill the Local Participation obligations of Amendment No. 1 to the AFA (which excludes the previously funded $9,600,000.00 in 2017 Proposition B bond funds) is as follows:

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On October 24, 2019, the Park and Recreation Board authorized Supplemental Agreement No. 3 to the Development Agreement with the Woodall Rodgers Park Foundation.

 

On December 11, 2019, the City Council authorized Supplemental Agreement No. 3 to the Development Agreement with the Woodall Rodgers Park Foundation, a Texas non-profit foundation, for the design, construction and financing of the Phase 2 expansion of Klyde Warren Park (“Park”) located at 2012 Woodall Rodgers Freeway to (a) include the Klyde Warren Park Phase 2 Extension and to (b) include a nearby portion of unused City right-of-way encompassed by the eastbound side of Woodall Rodgers Freeway service road, the southbound side of North Pearl Street, the southbound Olive Street on ramp to the Woodall Rodgers Freeway and adjacent parking lot to relocate the existing dog park component of the Park, collectively KWP2, by Resolution No. 19-1931.

 

On June 17, 2021, the Park and Recreation Board authorized (1) two Advanced Funding Agreements with TxDOT as follows: (i) on-system and; (ii) on-system maintenance and Amendment No. 1 (TxDOT Agreement No. CSJ 0916-07-034) for the Woodall Rodgers Park Deck Plaza Extension Structure On-System from west of Akard Street to St. Paul Street; and (iii) to provide funding for project costs in the amount of $7,900,000.00 from Park and Recreation Facilities (B) Fund and assign TxDOT as the project lead for the entire project; and (2) execution of the Advanced Funding Agreements including all terms, conditions, and documents required by the agreements.

 

On June 23, 2021, the City Council authorized two Advanced Funding Agreements with TxDOT as follows: (i) on-system and; (ii) on-system maintenance and Amendment No. 1 (TxDOT Agreement No. CSJ 0916-07-034) for the Woodall Rodgers Park Deck Plaza Extension Structure On-System from west of Akard Street to St. Paul Street; and (iii) to provide funding for project costs in the amount of $7,900,000.00 from Park and Recreation Facilities (B) Fund and assign TxDOT as the project lead for the entire project; and the execution of the Advanced Funding Agreements including all terms, conditions, and documents required by the agreements, by Resolution No. 21-1134.

 

On October 13, 2021, the City Council authorized execution of a revised Advanced Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) (TxDOT Agreement No. CSJ 0196-07-034), for the Woodall Rodgers Park Deck Plaza Extension Structure on-system from west of Akard Street to St. Paul Street to provide for a $1,700,000.00 increase in the City’s previously authorized construction costs allocation (Resolution No. 21-1134) from $7,900,000.00 to $9,600,000.00 from Park and Recreation Facilities (B) Fund, by Resolution No. 21-1688.

 

On April 12, 2023, the City Council authorized a Project Specific Agreement with Dallas County, for the County Transportation Major Capital lmprovements Projects 30246, to designate terms for the assignment of the City as the lead agency for the construction of the SS 366 (Woodall Rodgers Freeway) Deck Plaza Structure Extension (WRF2 Project), to establish the alignment, and to outline Dallas County funding participation and Dallas County attendance at meetings and inspection of construction of the planned WRF2 Project located west of Akard Street to St. Paul Street, and an increase in appropriations in an amount not to exceed $1,350,900.00 in the Woodall Rodgers Development Fund by Resolution No. 23-0492.

 

On December 4, 2025, the Park and Recreation Board approved the execution of Amendment No. 1 to the Advanced Funding Agreement (AFA) with the Texas Department of Transportation (TxDOT) (Agreement No. CSJ 0196-07-034) for the Woodall Rodgers Park Deck Plaza Extension Structure on-system from west of Akard Street to St. Paul Street to reflect updates in project budget and funding participation.
