Authorize a contract with Billingsley D&D, Inc. for the donation of privately funded design plans for the construction of a zero to four lane roadway identified as Copenhagen Avenue, which will include detailed design plans covering a segment of Copenhagen Avenue from East Belt Line Road to south of the Dallas Area Rapid Transit right-of-way in the City of Dallas and full schematic design plans covering Copenhagen Avenue from East Belt Line Road to Olympus Boulevard - Financing: This action has no cost consideration to the City (see Fiscal Information for potential future costs)

Body

BACKGROUND

On September 12, 2024, the Regional Transportation Council (RTC) of the North Central Texas Council of Governments approved the allocation of federal funding to construct a segment of the new four-lane roadway identified as Copenhagen Avenue extending from East Belt Line Road to south of the Dallas Area Rapid Transit (DART) right-of-way in the City of Dallas (“Project”).

On January 22, 2025, the City Council authorized the Notice of Intent to establish Quiet Zones along DART’s Silver Line corridor encompassing 11 railroad crossings, which included a crossing at the future Copenhagen Avenue in the Cypress Waters Development by Resolution No. 25-0208. The City Council subsequently authorized the Notice of Establishment for the same Quiet Zones on April 23, 2025, by Resolution No. 25-0641.

The future Copenhagen Avenue will cross the DART Silver Line rail line leading into the Cypress Waters Station and will support the establishment of the Quiet Zones in this area.

As approved by the RTC, the Texas Department of Transportation (TxDOT) will provide the City with $1,176,000.00 in federal funding for construction of the Project through an Advance Funding Agreement, which is included on this agenda for City Council consideration.

Billingsley D&D, Inc. is planning the development of the Cypress Waters area within the vicinity of the Project location. The City of Dallas and Billingsley D&D, Inc. have identified the Project as a priority. Billingsley D&D, Inc. has agreed to develop the full schematic design and the detailed design plans for the segment of the roadway at the DART Silver Line rail crossing, at its sole expense, and donate the design plans to the City to facilitate construction of the Project.

The detailed design is valued at $1,500,000.00 and covers the segment of Copenhagen Avenue from East Belt Line Road to south of DART’s right-of-way. The full schematic design will cover the roadway from East Belt Line Road to Olympus Boulevard.

If approved, this action will allow for the development and donation of the design plans and specifications in accordance with federal, state, and local standards to be provided to the City by Billingsley D&D, Inc. to be used for construction of the Project.
