Authorize (1) a Project Specific Agreement with Dallas County in the amount of $5,100,000.00, reduced by $100,000.00 for County in-house project delivery costs for a total of $5,000,000.00, for the construction of The Loop Project-U.S. 175 at Lake June Road Bridge, Pedestrian Bridge, and Trail Connections (Transportation - Major Capital Improvement Project No. 10244); (2) the receipt and deposit of funds in an amount not to exceed $5,000,000.00 from Dallas County for the required local contribution in the Transportation Special Projects Fund; and (3) the establishment of appropriations in an amount not to exceed $5,000,000.00 in the Transportation Special Projects Fund - Not to exceed $5,000,000.00 - Financing: Transportation Special Projects Fund

BACKGROUND
On July 6, 2021, the City of Dallas and Dallas County entered into a Master Agreement by Commissioners Court Order 2021-0697 for the purpose of transportation improvements on roads inside Dallas County. The City wishes to enter into a Project Specific Agreement (PSA) with Dallas County for the construction of The Loop Project-U.S. 175 at Lake June Road Bridge, Pedestrian Bridge, and Trail Connections, Major Capital Improvement Project No. 10244 (“Project”).
This project will connect Southeast Dallas to the rest of the city’s vibrant urban trail system, including connections between two Dallas Area Rapid Transit light rail stations. This project will provide a segment of the Loop Project; an ongoing project led by the Circuit Trail Conservancy. Improvements include construction of a separated urban trail along and crossing under U.S. 175; construction of a new urban trail north of U.S. 175 in the Trinity Forest; replacement of the Lake June Road Bridge over U.S. 175; and redesign of Lake June Road between an existing complete street project and Lake June Station.
The total estimated Project cost is $36,575,000.00 and is being funded from a combination of federal, state, and local funding sources. The total amount of local contribution is $5,000,000.00 and is being paid for by Dallas County.
The Texas Department of Transportation (TxDOT) and Dallas County requested the City of Dallas to facilitate the transfer of local contribution funds being provided solely by Dallas County to TxDOT to apply to the On-System roadway portion of the Project. TxDOT is the lead implementing agency for the On-System roadway portion of the project.
This action will authorize a Project Specific Agreement with Dallas County to receive the $5,000,000.00 in local contribution from Dallas County for the Project. The City’s performance under this Project Specific Agreement is conditioned upon the receipt and deposit of local contribution funds from Dallas County. On this agenda, the City Council will also consider an Advanced Funding Agreement with TxDOT to transfer the $5,000,000.00 in local contribution received from Dallas County to TxDOT for the Project.
This PSA is to specifically identify the Project changes in the rights and responsibilities of each party as set forth in the Master Agreement. This PSA will be an addition to the Master Agreement and incorporate each of its terms and conditions. All terms of the Master Agreement remain in full force and effect except as modified by the PSA. In the event of any conflict between the Master Agreement and the PSA, the PSA will control specifically to the Project.
Chapter 791 of The Texas Government Code and Chapters 251 and 472 of the Texas Transportation Code provide authorization for local governments to contract with each other for the performance of governmental functions and services, as well as joint funding of road construction or improvements of road or street projects.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 24, 2023, the City Council authorized an Advanced Funding Agreement with TxDOT to accept a Surface Transportation Block Grant (Agreement No. CSJ 0918-47-390, CFDA No. 20.205) as Federal share in the total project cost of $2,406,614.00, which includes $1,840,000.00 as Federal participation for environmental assessment, engineering, construction, and direct state costs, $106,614.00 as State participation for indirect state costs, and $460,000.00 as local participation for environmental assessment, engineering, construction, and direct state costs paid to TxDOT prior to construction for cost related to the preparation of preliminary engineering (schematic and environmental), final design, plans, specifications and estimates, and the reconstruction of Lake June Road from U.S. 175 to Gillette Street including rehabilitation of a 6 to 4 lane roadway including full depth pavement repair to include bike lanes, sidewalks, lighting, and traffic signal at Gillette Street and Lake June Road by Resolution No. 23-0698.
