SUBJECT
Title
An ordinance amending Chapter 43, “Streets and Sidewalks,” of the Dallas City Code, by amending Sections 43-46, 43-94, 43-95, 43-136, 43-139, 43-141, and 43-144; (1) providing an updated description of cement used in sidewalks, curbs, driveways, gutters, and pavements; (2) providing new requirements for residential and commercial driveway radiuses; (3) establishing an offense for failing to return right-of-way to public use; (4) providing a barricade permit defense to prosecution for failing to return right-of-way to public use; (5) providing updated requirements for steel plates used for covering pavement cuts; (6) requiring permittee and emergency contact information to be affixed to steel plates used for covering pavement cuts and be visible at all times; (7) reducing the limits required of a permittee to perform slurry seal treatment work; (8) requiring a utility clearance letter identifying facilities requiring schedule adjustments; (9) allowing the city to recover costs for expenses incurred as a result of delays caused by a public service provider’s failure to conform facilities; (10) providing a penalty not to exceed $500.00; (11) providing a saving clause; (12) providing a severability clause; and (13) providing an effective date - Financing: This action has no cost consideration to the City (see Fiscal Information)

BACKGROUND
This action will authorize an amendment to Chapter 43 of the Dallas City Code. The changes to the provisions are necessary to update references for the materials specifications for cement, standard construction configurations of driveway approaches, and clarify the intent for permitted uses of the public right-of-way. The changes are also anticipated to have positive impacts, including reduced inconvenience to the public.

FISCAL INFORMATION
This item has no cost consideration to the City; ordinance enforcement of penalty up to $500.00 may generate additional revenues to the City.
