Title
Authorize a construction services contract for capital improvements, including repair and renovation, of all four elevators at the Wyly Theatre - Nouveau Texas, LLC, most advantageous proposer of three - Not to exceed $2,343,171.67 - Financing: Cultural and Performing Arts Facilities (E) Fund (2024 General Obligation Bond Fund)

BACKGROUND
Since October 12, 2009, Dallas Center for the Performing Arts Foundation, Inc. (DCPAF) has been instrumental in creating one of the leading arts and cultural districts in the United States, which attracts 350,000 to 400,000 visits a year and is an economic driver for the City. The innovative “mechanical” design of the Wyly Theatre utilizes exposed elevator shafts, which have created unique challenges in maintaining operable elevators. These elevator units are susceptible to unplanned shutdowns, accelerated wear on equipment, and entrapments.
This project constitutes the capital improvements of all four elevators at the Wyly Theatre and ensures the district’s priority of life safety infrastructure and continued operational success.
The project scope includes:
• Replace motors, including ring gear and worm gears.
• Replace the elevator controllers with non-proprietary equipment for easy service, diagnosing, and maintenance.
• Work to be completed in each elevator cab includes new swing returns, new buttons, new cab lights, update 2-way communication to current code requirements, new position indicators, and card reader hardware.
• General Contracting work includes electrical work in machine room, fire alarm system hook ups and upgrades, and minor patching of walls.
• Drive sheaves, deflector sheaves, Hoistway cabling, counterweights, exterior door rollers, split door closures, door interlocks (2 on each floor), evaluation, repairs and cleaning of the elevator pit (especially the drains).
Nouveau Texas, LLC was selected following a one-step selection process in accordance with the City of Dallas and the State of Texas procurement guidelines.
It is now deemed desirable to authorize a construction services contract with Nouveau Texas, LLC. This contract will include the capital improvements of all four elevators at the Wyly Theatre of DCPAF, with a total contract amount not to exceed $2,343,171.67.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On September 28, 2005, the City Council authorized a Development and Use Agreement with the DCPAF for the long-term possession, operation, maintenance and use for the construction of first-class, multi-venue performance venue by Resolution No. 05-2859.
On October 8, 2008, the City Council authorized the First Amendment to the Performing Arts Center Use Agreement with the DCPAF for the long-term possession, operation, maintenance and use of the City Performance Hall underground parking garage by Resolution No. 08-2793.
On December 10, 2008, the City Council authorized the Performing Arts Center Development Agreement with the DCPAF for the design and construction of the Annette Strauss Artist Square by Resolution No. 08-3432.
On October 26, 2016, the City Council authorized the Third Amendment to the Use Agreement with the DCPAF to increase annual support from $2,500,000.00 to $4,000,000.00 to provide promotion and support of nonprofit arts and cultural organizations by Resolution No. 16-1750.
On October 28, 2020, the City Council authorized the Fourth Amendment to the Use Agreement with the DCPAF, to incorporate a revised Booking Rights Agreement, as jointly negotiated with the Dallas Symphony Association, Inc. and the DCPAF by Resolution No. 20-1699.
On February 14, 2024, the City Council authorized a May 2024 Bond Election to fund a variety of capital improvement projects citywide in by Resolution No. 24-0280; and Ordinance No. 32658.
On May 15, 2024, the City Council approved and adopted the canvassing committee’s report for the May 4, 2024 Bond Election, certifying the election results and declaring that a majority of voters supported all bond propositions, as set forth by Resolution No. 24-0695; and Ordinance No. 32658.
On June 25, 2025, the City Council authorized a construction services contract for one of the 2024 Bond Program Center Projects, namely the removal and replacement of two cooling towers at the Winspear Opera House utilizing a portion of the City’s Cultural and Performing Arts Facilities 2024 bond allocation of $13,077,806.00 in an amount not to exceed $1,108,969.00, by Resolution No. 25-1055.
On September 24, 2025, the City Council authorized the Fifth Amendment to the Use Agreement to enable the parties to undertake planning, design, construction, renovation, repair, replacement, and/or improvements to the Center, as further described in the Fifth Amendment by Resolution No. 25-1556.
