Authorize a four-year service price agreement for FirstNet services to provide public safety wireless devices and mobile services for the Department of Information & Technology Services with AT&T Enterprises, LLC through the Department of Information Resources cooperative agreement - Estimated amount of $23,934,014.39 - Financing: Data Services Fund ($4,932,673.63), 9-1-1 System Operations Fund ($1,026,253.92), General Fund ($14,694,265.77), Dallas Water Utilities Fund ($1,825,691.36) and Sanitation Operation Fund ($1,455,129.71)

BACKGROUND
This action does not encumber funds; the purpose of a service price agreement is to establish firm pricing for goods and services, for a specific term, which are ordered on an as needed basis according to annual budgetary appropriations. The estimated amount is intended as guidance rather than a cap on spending under the agreement so that actual need combined with the amount budgeted will determine the amount spent under this agreement.
This agreement will allow the Department of Information & Technology Services (ITS) continuous use of a communications platform dedicated specifically to first responders and public safety. FirstNet service is a highly secure communication network that provides preemptive and priority public safety wireless devices and mobile services. FirstNet service is utilized in all cellular devices, smart tablets, and mobile data computers used by the Fire-Rescue Department, Emergency Medical Services, and the Police Department. FirstNet Service will provide significantly increased network performance while reducing the annual cost of enterprise commercial wireless services.
It was learned when the City began the process to procure a new agreement for FirstNet that AT&T had undertaken multiple corporate changes and that the company whose name the DIR cooperative purchasing contract was entered into, no longer existed. Therefore the term of the contract begins February 12, 2024, so as to prevent a gap in service to first responders between the previous contract and this Contract and includes services provided by Contractor during the time the parties worked through the legal effect of the merger of AT&T Corp., a New York corporation into AT&T Enterprises, Inc., a Delaware corporation followed by the conversion of AT&T Enterprises, Inc., into AT&T Enterprises, LLC.
FirstNet provides enhanced service to first responders so that their devices do not have to compete with non-emergency cellular users for a cellular connection. This preemption will ensure that first responders have the communications capacity they need by detouring non-public safety users off the network to ensure quality of service for emergency personnel, much like civilian vehicle traffic is routed off a highway to make room for emergency personnel.
In future phases, ITS will continue to add secondary users to the FirstNet core network as requested. These secondary users will include critical infrastructure technology such as the Advanced Traffic Management System, Water Utility Industrial Control Systems, and crime area surveillance cameras.
The Department of Information Resources cooperative agreement is authorized by Chapter 791 of the Texas Government Code and Subchapter F, Chapter 271, Texas Local Government Code. Section 271.102 of the Texas Local Government Code authorizes a local government to participate in a Cooperative Purchasing Program with another local government or a local cooperative organization.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On February 13, 2019, the City Council authorized a two-year service price agreement, with two one-year renewal options for FirstNet services in an estimated amount of $3,715,370.32, by Resolution No 19-0269.
On August 11, 2021, the City Council authorized the execution of Supplemental Agreement No. 2 to exercise the first of two one-year renewal options in an estimated amount of $3,514,153.49, by Resolution No. 21-1265.
On February 22, 2023, the City Council authorized the execution of Supplemental Agreement No. 3 to exercise the second of two one-year renewal options in an estimated amount of $4,114,878.83, by Resolution No. 23-0323
