Title
Authorize the (1) acceptance of a grant from the State of Texas through the Texas Department of Transportation (TxDOT) for the Regional Toll Revenue (RTR) State Highway (SH) 121 toll project (Agreement No. CSJ 0918-47-513) in the amount of $1,200,000.00 as State contribution from the SH 121 Subaccount toward the total project cost of $1,500,000.00, which includes $300,000.00 as local participation which was met through design of the project, plus any cost overruns for construction of intersection improvements on Arapaho Road at Dallas Parkway within the City of Dallas, including modifications to the westbound left-turn lane, enhancements to pedestrian crosswalk facilities, and the installation of permanent traffic signal infrastructure (2) receipt and deposit of funds in the amount of $1,200,000.00 in the TxDOT RTR Arapaho Road at Dallas Parkway Improvements Fund; (3) establishment of appropriations in the amount of $1,200,000.00 in the TxDOT RTR Arapaho Road at Dallas Parkway Improvements Fund; and (4) execution of the Advance Funding Agreement with TxDOT and all terms, conditions, and documents required by the agreement - Total amount of $1,200,000.00 - Financing: TxDOT RTR Arapaho Road at Dallas Parkway Improvements Fund

BACKGROUND
The State of Texas received Regional Toll Revenue (RTR) Funds from the North Texas Tollway Authority as surplus revenue from the SH 121 toll project. Pursuant to Transportation Code, 228.006, the State of Texas shall authorize the use of surplus revenue from a toll project for transportation projects, highway projects, or air quality projects within the TxDOT district in which any part of the toll project is located. The North Central Texas Council of Governments’ (NCTCOG) Regional Transportation Council (RTC) was designated by the Texas Transportation Commission on October 26, 2006, to select and oversee projects to be financed using RTR Funds.
The DART Public Transportation Improvement Program identified this project as an eligible project to provide funding to reconstruct dated traffic signals and improve pedestrian safety at intersections along DART bus routes.
The total estimated cost for construction is $1,500,000.00, which includes $1,200,000.00 in State participation and $300,000.00 in local participation which was funded from the DART Transportation Projects Fund as part of the design of the project. The City is also responsible for any cost overruns associated with this project.
This action will authorize an Advance Funding Agreement with TxDOT to accept RTR Funds from the SH 121 Subaccount for the Arapaho Road at Dallas Parkway Improvements project, which involves the construction of intersection improvements on Arapaho Road at Dallas Parkway within the City of Dallas, including modifications to the westbound left-turn lane, enhancements to pedestrian crosswalk facilities, and the installation of permanent traffic signal infrastructure.

On June 14, 2023, the City Council authorized an interlocal agreement with DART for the distribution of up to $80,000,000.00 in funding from DART which consists of the City's portion of (i) excess sales tax funds from DART of $72,000,000.00 and (ii) additional RTC funds of approximately $8,000,000.00, all to be used to complete projects eligible for this funding that will benefit DART's Public Transportation System or provide Complementary Transportation Services located in Dallas by Resolution No. 23-0822.
