Authorize (1) contracts with cultural organizations for the provision of artist services to the City through the Cultural Organizations Program for the period October 1, 2020 through September 30, 2021 (list attached to the Agenda Information Sheet); and (2) an amendment to the COVID-19 Amended Guidelines: FY 2020-21 Cultural Organizations Program to provide for a one-time exception to the funding level restrictions for TeCo Theatrical Productions, Inc. d/b/a Bishop Arts Theatre Center - Not to exceed $4,832,026.00 $4,982,026.00 - Financing: General Fund

BACKGROUND
The Cultural Organizations Program (COP) provides funding for cultural services with established Dallas-based non-profit cultural organizations to support an array of programs that include concerts, plays, exhibitions, performances, workshops, and other cultural services, including virtual cultural services, over a twelve-month period. The Office of Arts and Culture (OAC) reviewed proposals from cultural organizations and applied objective administrative scoring per the revised program guidelines, which were approved by City Council in June 2020. Proposals and scores were analyzed by the Allocations Committee of the Arts and Culture Advisory Commission. Taking into account equity, administrative scoring, and organization budget size the Allocations Committee met three times over the summer and developed a funding recommendation unanimously approved by this standing committee. This recommendation was subsequently unanimously approved by the full Arts and Culture Advisory Commission in August.
Following Council Members’ proposed $500,000.00 budget increase for the Cultural Organizations Program above the City Manager’s Recommended FY 2020-21 Budget, the Arts and Culture Advisory Commission was presented an alternate funding scenario that applied the same logic and formulas as the originally approved August recommendation. The Arts and Culture Advisory Commission voted unanimously to recommend this alternate funding scenario.
In the City Council approved FY 2020-21 COP Guidelines, as amended, the Funding Level Restrictions are as follow:
Funding Level Restrictions
A. The limit on support through the COP is scaled to be proportional, based on an organization’s most recently completed fiscal year’s audited revenue, and in no case shall the amount of funding for an organization through the COP be greater than:
(i) 25% of most recent year’s audited revenue for organizations with revenue less than $1 million;
(ii) 15% of most recent year’s audited revenue for organizations with revenue between $1 million and $5 million;
(iii) and 10% of most recent year’s audited revenue for organizations with revenue greater than $5 million.
The most recently completed fiscal year’s audited revenue for TeCo Theatrical Productions, Inc., d/b/a Bishop Arts Theatre Center is $1,120,092, and by the COP Guidelines, their COP funding level restriction is 15% of their revenues, or $168,014. The funding recommendation from the Arts and Culture Advisory Commission for Bishop Arts Theatre Center was $115,782.00.
The amendment made by the Quality of Life, Arts and Culture Committee increased the contract amount for Bishop Arts Theatre Center by $150,000.00, from $115,782.00 to $265,782.00, or 23.7% of their revenue for the most recently completed fiscal year. Because this amount exceeds, by $97,768.00, the Funding Level Restriction previously approved by City Council, an amendment to the COVID-19 Amended Guidelines: FY 2020-21 Cultural Organization Program would provide for a one-time exception to allow this increase.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On February 26, 2020, City Council approved a resolution which authorized and established the Cultural Organizations Program within the Office of Arts and Culture to support cultural services in the City of Dallas and approved the program guidelines by Resolution No. 20-0327.
On June 24, 2020, City Council approved the amended FY 2020-21 COP Guidelines due to COVID-19 impacts on planning for cultural events by Resolution No. 20-0991.
On August 10, 2020, the Allocations Committee of the Arts and Culture Advisory Commission approved a recommendation in support of the FY 2020-21 Cultural Organizations Program funding allocations.
On September 13, 2020, the Arts and Culture Advisory Commission unanimously approved a recommendation in support of alternate FY 2020-21 Cultural Organizations Program contracts to reflect FY 2020-21 updated budget proposals to increase the Cultural Organizations Program budget.
On October 19, 2020, the Quality of Life, Arts and Culture Committee will be briefed on this item on October 19, 2020. voted to increase the COP contract funding for Bishop Arts Theatre Center by $150,000 to further advance the goals of the Dallas Cultural Plan, to require a private match of $150,000 from Bishop Arts Theatre Center, and to amend the COVID-19 Guidelines: FY 2020-21 Cultural Organizations Program to provide for a one-time exception to the funding level restrictions in the program guidelines to allow for this increase.
