Authorize (1) an increase in the construction services contract with John Burns Construction Company of Texas, LLC for additional work associated with air release valve improvements to the White Rock North Transmission Main system in an amount not to exceed $1,800,060.00; and (2) a reduction in the Wastewater (Clean Water)-TWDB 2018 Fund in an amount not to exceed $476,400.00 - Total not to exceed $1,800,060.00, from $15,383,455.00 to $17,183,515.00 - Financing: Water Capital Improvement F Fund ($2,276,460.00) and Wastewater (Clean Water) - TWDB 2018 Fund (-$476,400.00)

BACKGROUND
On January 13, 2021, the City authorized a construction services contract for the installation of water and wastewater main improvements at 12 locations and water transmission main valve improvements at 27 locations. The construction contract included air release valve improvements on the 90-inch and 84-inch diameter White Rock North Water Transmission Main. This critical pipeline moves up to 190 million gallons of water per day to customers in North Dallas, East Dallas and customer cities. Sudden disruptions in pump operation, such as would result from a power outage, can cause pressure surges which could rupture the pipeline. A pipeline rupture would cause property damage and disruption in service to water customers. The air release valve improvements will reduce the risk of pipe rupture from surge events and should be completed as soon as possible to protect this critical pipeline.
This action will authorize an increase in the contract with John Burns Construction Company of Texas, LLC for additional work associated with air release valve improvements to the White Rock North Transmission Main system. The work was originally part of another construction contract that included installation and replacement of various air release valves. However, the contractor had several payment disputes with subcontractors, submitted unreasonable payment claims, and unilaterally demobilized from the site without completing the entire work. Despite exhaustive efforts to work with the contractor and surety company, neither has upheld their contractual obligation to complete the work ultimately prompting the City to terminate the original contract.
The work includes five 18-inch diameter taps, one 8-inch air release valve installation, and eight 6-inch air release valve installations on water transmission main infrastructure. Additionally, the contractor will finish associated items left incomplete by the previous contractor and surface restoration of sites with previous activity by the original contractor.

On August 28, 2019, the City Council authorized a construction contract services with John Burns Construction Company of Texas, Inc., for the installation of water and wastewater mains at 14 locations by Resolution No. 19-1286.
On December 14, 2022, the City Council authorized an increase in the construction services contract with John Burns Construction Company of Texas, Inc., for the emergency repair of two parallel 48-inch diameter wastewater siphons just upstream of Cottonwood Creek by Resolution No. 22-1811.
