An ordinance amending Ordinance No. 32863, previously approved on September 18, 2024 to add (1) Subsection (g), “Other Abandonment Regulations,” of Section 2-26.2, “Abandonment of Public Rights-of-Way,” of Division 1, “Generally,” of Article III, “Management and Sale of City-Owned Real Property,” of Chapter 2, “Administration,”; and (2) Subsection (h), “Abandonment Credit for Private Streets, Alleys, and Drives,” of Section 2-26.2, “Abandonment of Public Rights-of-Way,” of Division 1, “Generally,” of Article III, “Management and Sale of City-Owned Real Property,” of Chapter 2, “Administration,” of the Dallas City Code; (3) providing a saving clause; (4) providing a severability clause; and (5) providing an effective date - Financing: No cost consideration to the City

BACKGROUND
In compliance with the City’s Financial Performance Management Criteria (FMPC) #12, the City conducts an annual review of selected fees and charges to determine the extent to which the City is recovering the full cost of associated services. As a result, the FY 2024-25 budget included changes to various fees including Library Services, Facilities and Real-Estate Management Services, and Transportation and Public Works Services.
During a review of Ordinance No. 32863, staff determined that (1) Subsection (g), “Other Abandonment Regulations,” of Section 2-26.2, “Abandonment of Public Rights-of-Way,” of Division 1, “Generally,” of Article III, “Management and Sale of City-Owned Real Property,” of Chapter 2, “Administration,”; and (2) Subsection (h), “Abandonment Credit for Private Streets, Alleys, and Drives,” of Section 2-26.2, “Abandonment of Public Rights-of-Way,” of Division 1, “Generally,” of Article III, “Management and Sale of City-Owned Real Property,” of Chapter 2, “Administration,” of the Dallas City Code were inadvertently omitted from the ordinance.
This amended ordinance will add these two missing sections to Ordinance No. 32863
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On September 18, 2024, the City Council approved Ordinance No. 32863 amending Chapters 2, 18, 24, 28, 43, 49, 51A, and 52 of the Dallas City Code and Ordinance No. 19860, as amended, passed by the city council on February 10, 1988, for various fee adjustments.
