Authorize an increase in the construction services contract with Energy Resources, Inc., for additional work associated with the dredging of the pond located within Watercrest Park at Lake Highlands Town Center - Not to exceed $499,605.67, from $2,800,700.00 to $3,300,305.67 - Financing: Flood Control (D) Fund (2017 General Obligation Bond Fund) ($100,305.67) and Skillman Corridor TIF District Fund ($399,300.00)

BACKGROUND
On March 9, 2022, the City Council authorized a construction services contract with Energy Resources, Inc. for dredging of the pond located within Watercrest Park at Lake Highlands Town Center by Resolution No. 22-0478. The seven-acre pond has accumulated significant sediment since its construction in 2009 and has been reduced from a 6-foot average depth to 1-2 feet (a reduction in volume of approximately 90 percent). The contractor will dredge approximately 42,600 cubic yards of accumulated sediment to restore the pond to a depth of 9 feet in the southern portion and perform a light dredge of 1.5 feet in the northern portion to preserve natural habitat.
This action will authorize Change Order No. 1 to the construction services contract with Energy Resources, Inc. for additional work associated with dredging of the pond. After award of the construction contract, it was determined that the anticipated access and staging area was not available. The contractor and City staff worked together to find another suitable access route and staging area to complete the work. After significant coordination, a new access route was agreed upon along with a staging and material storage area that would not disturb the community at the Lake Highlands Town Center. This new access route and staging area required significant clearing and grubbing and a ramp to be constructed off Walnut Hill Lane. The change order will compensate the contractor for the additional cost associated with building the ramp and clearing the material and storage areas for use during the dredging operation.
