A resolution authorizing the (1) execution of a termination of lease agreement between the City of Dallas and Dallas Firefighter's Museum, Inc. for approximately 6,882 square feet of land and 8,816 square feet of building space, located at 3801 Parry Avenue, to be effective upon the execution of the Agreement between the City and Dallas Firefighter's Museum, Inc; (2) transfer of the improved property to Dallas Firefighter's Museum, Inc. subject to restrictive covenants, a right to revert, and execution of all necessary documents, pursuant to Section 253.011 of the Texas Local Government Code; and (3) execution of an agreement pursuant to the Texas Local Government Code to ensure that the property is used in a manner that primarily promotes a public purpose of the City - Financing: No cost consideration to the City

BACKGROUND
This item, on behalf of Dallas Fire and Rescue, authorizes the (1) execution of a termination of lease agreement between the City of Dallas and Dallas Firefighter's Museum, Inc. for approximately 6,882 square feet of land and 8,816 square feet of building space, located at 3801 Parry Avenue, to be effective upon the execution of the Agreement between the City and Dallas Firefighter's Museum, Inc.; (2) transfer of the improved property to Dallas Firefighter's Museum, Inc. subject to restrictive covenants, a right to revert, and execution of all necessary documents, pursuant to Section 253.001 of the Texas Local Government Code ("Code"); and (3) execution of an agreement pursuant to the Code to ensure that the property is used in a manner that primarily promotes a public purpose of the City. The transfer will provide for the continued use as a museum and gift shop, procuring, caring for, and displaying fire apparatus, equipment, memorabilia, and artifacts, and educating the public about fire prevention and fire safety.
The Dallas Firefighter's Museum requested the transfer of property to allow redevelopment of the Museum property by actively pursuing a capital campaign to raise a minimum of $3,000,000.00 for the redevelopment of the building's interior.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On June 13, 2007, the City Council authorized a thirty-year Lease Agreement with Dallas Firefighter’s Museum, Inc. for the continued use of former Fire Station No. 5 as a museum, gift shop and educational resource to students and the general public, containing approximately 8,816 square feet of space located at 3801 Parry Avenue, by Resolution No. 07-1749.
On April 14, 2010, the City Council authorized (1) a First Amendment to the Lease Agreement with Dallas Firefighter’s Museum, Inc., as Lessee, of an approximately 8,816 square foot two-story building, formerly Fire Station No. 5, located at 3801 Parry Avenue to extend the term of the lease for an additional three years to provide additional time to perform renovations; and (2) an increase in the amount of funds to be expended by lessee, as required by the Lease by Resolution No. 10-0888.
