Title
Authorize (1) an Advance Funding Agreement with the Federal Highway Administration through the Texas Department of Transportation (TxDOT) (Agreement No. CSJ 0918-47-474, Assistance Listing No. 20.205) for the Congestion Mitigation and Air Quality (CMAQ) Program for design and construction of the Five Mile Creek Trail in the amount of $16,101,316.00 of which the Federal portion is $15,400,000.00 (includes $154,000.00 in State Direct Costs), the State’s portion is $701,316.00, and the local match portion is $3,080,000.00 to be provided through the use of Transportation Development Credits; (2) the establishment of appropriations in the amount of $15,246,000.00 in the TxDOT CMAQ Five Mile Creek Westmoreland DART Grant Fund; (3) the receipt and deposit of funds in the amount of $15,246,000.00 to the TxDOT CMAQ Five Mile Creek Westmoreland DART Grant Fund; and (4) the execution of the agreement and all terms, conditions and documents required by the agreement - Total amount of $15,246,000.00 - Financing: TxDOT CMAQ Five Mile Creek Westmoreland DART Grant Fund

BACKGROUND
In 2023, the City of Dallas was awarded Congestion Mitigation and Air Quality (CMAQ) Program funding from the North Central Texas Council of Governments, in the amount of $16,101,316.00, for the design and construction of the Five Mile Creek Trail from Westmoreland Road to the Westmoreland DART Station and to Westmoreland Park; and from Hampton Road at Kiest Boulevard to Rugged Drive.
The project is funded completely with federal sources, with the use of Transportation Development Credits to serve as the required local match.
A Transportation Development Credit (TDC) is a financial accounting tool approved by the Federal Highway Administration allowing the use of federal funding without the requirement of a cash match. These credits are non-cash credits allocated to states as a representative value to account for toll road and tolled managed lanes that benefit the federal system.
Mobility 2045, the region’s current Metropolitan Transportation Plan, makes recommendations consisting of policies, programs, and projects that reflect regional priorities and support Mobility 2045 goals. However, the construction of infrastructure projects alone cannot achieve the goals of Mobility 2045.
To encourage the development of alternative, strategic solutions, Mobility 2045 includes a voluntary list of policies that local governments and transportation agencies can choose to adopt. These policies aim to address issues that affect transportation in the region and cover a wide range of topics. By voluntarily adopting 50 percent of these policies, participating agencies will receive an offset of local funds in federal transportation projects in the form of TDC’s. The City of Dallas participates in this program and is therefore eligible for the use of TDC’s.
The CMAQ Program utilizes federal funding, administered by Texas Department of Transportation (TxDOT). Acceptance of all federal-aid project funds are subject to Disadvantaged Business Enterprises Program (DBE) requirements and the City must operate under TxDOT’s DBE program, rather than the City’s Business Inclusion and Development Plan. This Advance Funding Agreement sets forth the parameters for both agencies and specifies the responsibilities of each.

On January 9, 2025, the Park and Recreation Board authorized an Advance Funding Agreement with the Texas Department of Transportation (Agreement No. CSJ: 0918-47-474) for design and construction of the Five Mile Creek Trail.
