BACKGROUND

 

This item authorizes the second step of acquisition for condemnation by eminent domain to acquire eleven parcels for a total of approximately 78,483 square feet of land (list attached to the Agenda Information Sheet) located near the intersection of Pontiac Street and Cadillac Drive for the Cadillac Heights Phase II Project. The properties are encumbered with title issues, and/or owners who have declined the City’s offer to acquire.  The City will not be able to close the transactions amicably.

 

The parcels will be used for City service and maintenance facilities. The considerations are based on independent appraisals.

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On August 25, 2021, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Payless 4 More, LLC of approximately 7,600 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 21-1362.

 

On August 25, 2021, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Tom Moore et al., the Estate of Severino Fuentes Sanchez and Eduardo Ramirez of the tracts or parcels of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 21-1363.

 

On October 13, 2020, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Audrey Lou Bradley and Dorothy Lee

Bradley of approximately 11,266 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 20-1523.

 

On October 13, 2020, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Juan Coronado of approximately 5,668 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 20-1524.

 

On January 13, 2021, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Abel Medrano and Cynthia Medrano of approximately 7,522 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 21-0123.

 

On May 12, 2021, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Clarence Sneed, Antonio Bueno, Jr. and Mauricia Bueno of approximately 5,668 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 21-0747.

 

On January 27, 2021, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Cheryl Ann Pennington Brooks of approximately 5,200 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 21-0220.

 

On January 26, 2022, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from the Heirs at low of A.T. Mitchell, wife, Nellie Mitchell, heirs at law of Anselmo Valdivia, deceased, and wife, Dawn Valdivia and Rogelio Garcia Hernandez, as their interests may appear of approximately 5,406 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 22-0236.

 

On October 23, 2013, the City Council authorized the necessity of acquiring real property and authorizing its purchase for public use from Margie Deleon of approximately 7,500 square feet of land located in Dallas County for the Cadillac Heights Phase II Project by Resolution No. 13-1847.
