Authorize Supplemental Agreement No. 5 to the lease agreement with Austin Street Center to provide a fifteen-month extension to the lease agreement for approximately 20,000 square feet of shelter space located at 2929 Hickory Street, to be used for sheltering operations during inclement weather by the Office of Emergency Management and Crisis Response for the period January 1, 2026 through March 31, 2027 - Not to exceed $2,000,000.00 (subject to annual appropriations) - Financing: General Fund

BACKGROUND
This item authorizes Supplemental Agreement No. 5 to the lease agreement with Austin Street Center. The term of the original lease plus the extension options expires on December 31, 2025. This item will provide an additional fifteen-month extension to the lease agreement for approximately 20,000 square feet of shelter space located at 2929 Hickory Street. This extension term will provide for sheltering operations during inclement weather at the request of the Office of Emergency Management and Crisis Response. The total annual cost of $1,000,000.00 encompasses the base rent of $10,000.00 per month and Landlord enhanced services for the sheltering of individuals during inclement weather during the lease term.
The Office of Emergency Management and Crisis Response requires space for emergency sheltering during the term of this agreement.
Due to a higher-than-anticipated number of inclement weather days in 2025, the funding for this lease agreement and Landlord enhanced services has been expended. This Supplemental Agreement No. 5 will provide funding in an amount not to exceed $1,000,000.00 for a period beginning January 1, 2026, and will extend the lease term through March 31, 2027.
The current contract expires on December 31, 2025. The proposed extension is scheduled for City Council consideration on January 14, 2026, with a stated start date of January 1, 2026. This results in a technical gap between contract expiration and Council approval.
To address this timing issue, the extension is structured to be effective retroactive to January 1, 2026, the day immediately following the expiration of the prior contract. This approach ensures continuity of services and contractual coverage upon Council approval.
During the interim period, services continue without interruption while the extension is under negotiation and pending formal approval.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On December 14, 2022, the City Council authorized a lease agreement with Austin Street Center to provide temporary inclement weather services with a base rental of $10,000.00 per month plus Landlord enhances services not to exceed $744,907.68 annually by Resolution No. 22-1775.
On June 25, 2025, the City Council authorized additional funding by ratifying an additional amount not to exceed $476,122.44 for payment of outstanding invoices for expenses related to a higher-than-anticipated number of inclement weather days by Resolution No. 25-1059.
The City Council was briefed on the “Winter Weather Operations plans” on November 5, 2025.
