Title
Authorize the (1) acceptance of supplemental funding from the U.S. Environmental Protection Agency (EPA) for the FY 2023 Brownfields Revolving Loan Fund (RLF) Grant via Cooperative Agreement (Grant No. 4B02F40101, Assistance Listing No. 66.818) in the amount of $250,000.00 to clean up brownfield sites and provide cleanup planning and community involvement related activities for brownfield sites for the period November 1, 2023 through September 30, 2029; (2) execution of the Cooperative Agreement and all necessary documents; (3) increase of appropriations in an amount not to exceed $250,000.00 from $1,000,000.00 to $1,250,000.00 in the Brownfields Revolving Loan Fund Grant Fund; (4) receipt and deposit of additional funds in an amount not to exceed $250,000.00 in the Brownfields Revolving Loan Fund Grant Fund; (5) execution of Brownfield Revolving Fund Loan Agreements and all necessary documents with future subrecipients for loans and subgrants to support the assessment and cleanup of contaminated properties; (6) approval and execution of individual Brownfield Revolving Fund Loan Agreements through Administrative Action in an amount not to exceed $1,000,000.00, with individual loans or subgrants greater than $1,000,000.00 to be presented to City Council for separate authorization prior to execution and disbursement; (7) procurement, negotiation, and execution of agreements with one or more external qualified firms, selected through a request for proposals or other applicable competitive procurement process, to provide underwriting, loan servicing, portfolio management, and related professional services necessary to administer the Brownfields Revolving Loan Fund Program; (8) disbursement of grant funds, including supplemental funds authorized by this action, in an overall total amount not to exceed $1,250,000.00 and to receive, deposit, and record loan principal and interest repayments; (9) administration of the Brownfields Revolving Loan Fund Program in accordance with the terms and conditions of the U.S. Environmental Protection Agency (EPA) Brownfields Revolving Loan Fund Cooperative Agreement and all applicable federal, state, and local requirements; and (10) execution of the award with the EPA and all terms, conditions, and documents required by the agreement - Not to exceed $250,000.00 from $1,000,000.00 to $1,250,000.00 - Financing: Brownfields Revolving Loan Fund Grant Fund

BACKGROUND
In November 2023, the City Council authorized acceptance of a $1,000,000.00 EPA Brownfields Revolving Loan Fund (RLF) Cooperative Agreement Grant by Resolution No. 23-1572. EPA has since awarded the City $250,000.00 in supplemental funding under the same Cooperative Agreement, increasing the total RLF award to $1,250,000.00.
The RLF provides loans and subgrants to eligible entities to support brownfield assessment and cleanup associated with redevelopment projects within the City of Dallas.
The resolution approves and executes individual Brownfield Revolving Fund Loan Agreements through Administrative Action for loans or subgrants in an amount not to exceed $1,000,000.00. Individual loans or subgrants in an amount greater than $1,000,000.00 will be presented to City Council for separate authorization prior to execution and disbursement.
The resolution also authorizes procurement and execution of agreements with qualified firms, selected through an applicable competitive procurement process, for RLF underwriting, loan servicing, portfolio management, and related administration, subject to available appropriations, the Cooperative Agreement, applicable procurement requirements, and approval.
The Brownfields Revolving Loan Fund Program will be administered in accordance with the terms and conditions of the Brownfields Revolving Loan Fund Cooperative Agreement between the City and the EPA, as may be amended, and all applicable federal, state, and local requirements. The Cooperative Agreement, attached to the resolution and incorporated by reference as Exhibit A, governs program administration, eligible activities, reporting, compliance, and other requirements applicable to the grant funds.
As subrecipients repay their loans, principal and interest payments will be deposited and recorded in the Brownfields Revolving Loan Fund Grant. The respective notes receivable for repayment of principal and estimated interest amounts are specific to each approved loan agreement.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On November 8, 2023, the City Council authorized the acceptance of the $1,000,000.00 EPA Brownfields Revolving Loan Fund Cooperative Agreement Grant by Resolution No. 23-1572.
