Authorize an amendment by adding to Resolution No. 23-1637, previously approved on December 13, 2023, for an Advance Funding Agreement with the Texas Department of Transportation (TxDOT) to (1) accept the grant from the Federal Highway Administration through TxDOT for the Surface Transportation Block Grant (STBG) Program (Agreement No. CSJ 0918-47-275, Assistance Listing No. 20.205) for the West Commerce Street from Fort Worth Avenue to Riverfront Boulevard Project in the amount of $8,270,000.00; (2) establish appropriations in an amount not to exceed $8,187,300.00 in the TxDOT STBG West Commerce-Fort Worth Avenue Fund; and (3) receive and deposit funds in an amount not to exceed $8,187,300.00 to the TxDOT STBG West Commerce-Fort Worth Avenue Fund - Total amount of $8,187,300.00 - Financing: STBG West Commerce-Fort Worth Avenue Fund

BACKGROUND
The West Commerce Street from Fort Worth Avenue to Riverfront Boulevard Project is a partnership project between the City of Dallas and TxDOT to construct sidewalks and bicycle lanes along West Commerce Street. The City is the lead agency to administer the design and construction of the project.
On August 30, 2018, the Texas Commission passed Minute Order Numbers 115291 and 115292 authorizing the State to undertake and complete a highway improvement or other transportation projects generally described as bicycle and pedestrian improvements.
On August 16, 2023, the Texas Transportation Commission (“Commission”) passed Minute Order Numbers 116522 authorizing the State to undertake and complete a highway improvement or other transportation projects generally described as bicycle and pedestrian improvements.
On December 13, 2023, the City Council authorized an Advance Funding Agreement (CSJ No. 0918-47-324) for preliminary engineering, plans, specifications, and estimates, and the construction of sidewalks and bicycle lanes on West Commerce Street from Fort Worth Avenue to Riverfront Boulevard, by Resolution No. 23-1637.
This action will authorize an amendment to Resolution No. 23-1637, previously approved on December 13, 2023, for an Advance Funding Agreement with the Texas Department of Transportation (TxDOT) to (1) accept the grant from TxDOT for the STBG Program for West Commerce Street from Fort Worth Avenue to Riverfront Boulevard in the amount of $8,270,000.00; (2) establish appropriations in an amount not to exceed $8,187,300.00 in the TxDOT STBG West Commerce-Fort Worth Avenue Fund; and (3) receive and deposit funds in the amount of $8,187,300.00 to the TxDOT STBG West Commerce-Fort Worth Avenue Fund.
The estimated total project cost is $8,657,259.00, of which the total reimbursable cost is $8,270,000.00. The amount of $82,700.00 will be paid to TxDOT as a Direct State Cost and the remaining $8,187,300.00 is the total reimbursable cost to the City of Dallas.
