Authorize an increase in the construction services contract with Gibson & Associates, Inc. for additional in-field quantity adjustments associated with the construction of the Union Bikeway Connector Project from Houston Street and Nowitzki Way to the intersection of Harwood Street and Woodall Rodgers Freeway access road to allow for close-out of the completed project - Not to exceed $180,468.44, from $1,088,613.05 to $1,269,081.49 - Financing: Bike Lane Fund

BACKGROUND
This project provided for the construction services for bicycle and pedestrian improvements. On December 13, 2017, the City Council adopted the Downtown Dallas 360 Plan Update. This plan included a list of streets with proposed bicycle and pedestrian improvements in downtown and the surrounding neighborhoods. The list covers the streets affected by this project.
The Dallas union Bikeway project included construction of pavement markings, concrete sidewalks, barrier free ramps, street signage, traffic signal modification and other miscellaneous items necessary to facilitate bicycle and pedestrian improvements.
On May 25, 2022, the City Council Authorized the construction contract with Gibson & Associates, Inc., for the Union Bikeway Connector Project, in the amount of $1,015,842.45.
On August 30, 2023, Change Order No. 1 was authorized by Administrative Change Order No. 23-0979 to correct plan set pages with no contract amount increase. On September 15, 2023, Change Order No. 2 was authorized by Administrative Change Order No. 23-0992 to increase the construction contract in the amount of $57,134.50 for miscellaneous increases and decreases in in-field quantity adjustments and to add additional working days to the contract. On October 12, 2023, Change Order No. 3 was authorized by Administrative Change Order No. 23-1201 to increase the construction contract in the amount of $4,002.10 to add an additional pedestrian ramp with connecting crosswalk and to add additional working days to the contract. On November 17, 2023, Change Order No. 4 was authorized by Administrative Change Order No. 23-1510 to increase the construction contract in the amount of $11,634.00 for the relocation of a signal cabinet, miscellaneous in-field quantity adjustments, and to add additional working days to the contract.
The previously approved change orders culminated in an increase from 170 working days to 256 working days to accommodate multiple factors including interruption from an adjoining construction work for the Hillwood Development Project, and an increase from the original contract amount of $1,015,842.45 to $1,088,613.05 for construction related needs.
This action will authorize Change Order No. 5 for an increase in the construction services contract with Gibson & Associates, Inc., in the amount of $180,468.44, from $1,088,613.05 to $1,269,081.49, totaling a 24.93% increase, to allow for project close-out and account for in-field construction quantity adjustments that are authorized in the contract.

On September 25, 2019, the City Council authorized an Advance Funding Agreement and the acceptance of a grant from the U.S. Department of Transportation, Federal Highway Administration through the Texas Department of Transportation (TxDOT) for the Transportation Alternative Set-Aside (TASA) Grant (Agreement No. CSJ 0918-47-210, CFDA No. 20.205) in the amount of $554,682.00 as federal share in the total project cost estimate of $834,311.00 (includes Federal $554,682.00, Direct State $55,468.00, and Indirect State $36,956.00 participation totaling $647,106.00) for costs related to the construction of the separated bicycle and pedestrian trail connection to include conflict zone at intersections and driveways, and new signal locations from Houston Street to Klyde Warren Park known as the Union Bikeway Connector, by Resolution No. 19-1487.
On May 25, 2022, the City Council authorized a construction contract for the Dallas Union Bikeway connector project from Houston Street and Nowitzki Way to the intersection of Harwood Street and Woodall Rodgers Freeway access road with Gibson & Associates, Inc., in the amount of $1,015,842.45, by Resolution No. 22-0797.
