Title
Authorize a three-year service price agreement for the period October 14, 2026 through October 13, 2029, with two, one-year renewal options for median and right-of-way grounds maintenance services for the Department of Transportation and Public Works - Good Earth Corporation, most advantageous proposer of four - Estimated amount of $22,498,940.00 - Financing: General Fund ($22,228,940.00) and Bond Program Administration Fund ($270,000.00) (subject to annual appropriations)

BACKGROUND
This action does not authorize or encumber funding. The service price agreement establishes pre-negotiated pricing and contract terms for a specified period of time. Actual expenditures will occur only when services are requested and are supported by available departmental appropriations. The estimated amount represents the maximum anticipated value based on all potential usage scenarios during the contract term and is provided for planning purposes only. Actual expenditures may vary significantly and will be driven by operational needs. For reference, the City's average annual expenditure for these services over the past three years has been approximately $3,747,000.00 per year.
This service price agreement will provide for median and right-of-way grounds maintenance services for the Department of Transportation and Public Works. Citywide litter removal and mowing services are essential to maintaining safe, clean, and visually appealing public roadway rights-of-way. Routine litter removal, mowing, and management of ground-level vegetation help keep medians and other public spaces well-maintained, preserve clear sightlines, and support an attractive urban environment. These services will provide consistent, reliable maintenance that enhances the appearance of major roadway corridors and the City’s public spaces.
A six-member committee from the following departments reviewed and evaluated the qualifications:
• Dallas Water Utilities Department (1)
• Department of Equipment and Fleet Management (1)
• Department of Transportation and Public Works (2)
• Office of Procurement Services (2)*
*The Office of Procurement Services evaluated cost, local preference, and the Developing Regional and Inclusive Vendor Enterprises (DRIVE) Policy, if applicable.
The committee selected the successful respondent on the basis of demonstrated competence and qualifications under the following criteria:
• Approach and workplan 30 points
• Experience 20 points
• DRIVE Policy 20 points
• Cost 15 points
• Use of non-gas powered equipment 10 points
• Local Preference 5 points
As part of the solicitation process and in an effort to increase competition, the Office of Procurement Services used its procurement system to send out email notifications to vendors registered under relevant commodity codes. To further increase competition, the Office of Procurement Services uses historical solicitation information, the Internet, and vendor contact information obtained from user departments to contact additional vendors.
On November 10, 2015, the City Council authorized a living wage policy that requires contractors to pay their employees a “living wage” rate as established annually by the Massachusetts Institute of Technology Living Wage Calculator for Dallas County by Resolution No. 15-2141. The calculated living wage during the solicitation process of this contract is $23.06; the selected vendor meets this requirement.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On April 8, 2026, the City Council authorized (1) the rejection of proposals received for Group 1 for median and right-of-way grounds maintenance services for the Department of Transportation and Public Works; (2) the re-advertisement for Group 1 for median and right-of-way grounds maintenance services for the Department of Transportation and Public Works; and (3) a three-year service price agreement for Groups 2 through 31 and 33 through 37 for citywide grounds maintenance services with Good Earth Corporation, BrightView Landscape Services, Inc, V.L. & I., Inc dba URBAN LANDSCAPING & IRRIGATION, and Abescape Group, LLC by Resolution No. 26-0643.
