BACKGROUND
This item authorizes the second step of acquisition for condemnation by eminent domain to acquire approximately 1,200 square feet of land for a drainage easement and 1,500 square feet of land for a temporary workspace easement from John D. Garay, Heirs of Jose Garay, Jr., and Heirs of Alice Garay, located at 2411 Throckmorton Street near its intersection with Sylvester Avenue for the Throckmorton-Reagan Drainage Improvements Project. This property will be used for the purpose of improving the storm drainage system to address flooding in the area. The consideration is based on an independent appraisal. There are no relocation benefits associated with this acquisition.
The first resolution approved on August 14, 2024, by Resolution No. 24-1120, authorized the purchase in the amount of $153,450.00, based upon an independent appraisal. This property will be used for storm drainage system improvements associated with the Throckmorton-Reagan Drainage Improvement Project.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On August 14, 2024, the City Council authorized acquisition of approximately 1,200 square feet of land for a drainage easement and 1,500 square feet of land for a temporary workspace easement from John D. Garay, located at 2411 Throckmorton Street near its intersection with Sylvester Avenue for the Throckmorton-Reagan Drainage Improvements Project by Resolution No. 24-1120.
