An ordinance granting a private license to 1815 N. Market Street, LLC for the use of a total of approximately 2,013 square feet of land to occupy, maintain and utilize an existing loading dock and sidewalk cafe and installation and use of a canopy and a trash dumpster with enclosure on portions of Record Street and Munger Avenue rights-of-way located near the intersection of Record Street and Munger Avenue. Revenue: General Fund $1,200.00 annually, plus the $20.00 ordinance publication fee

BACKGROUND
This item grants a private license to 1815 N. Market Street, LLC for the use of a total of approximately 2,013 square feet of land to occupy, maintain and utilize an existing loading dock and sidewalk cafe and installation and use of a canopy and a trash dumpster with enclosure on portions of Record Street and Munger Avenue rights-of-way located near the intersection of Record Street and Munger Avenue. The use of this area will not impede pedestrian or vehicular traffic. The term of this license is 40 years.
The licensee will indemnify the City and carry general liability insurance naming the City as an additional insured.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On May 25, 1988, the City Council authorized a revocable license to use and maintain an existing loading dock on a portion of Record Street and Munger Avenue rights-of-way by Resolution No. 88-1696, Ordinance No. 19966.
On September 25, 1996, the City Council authorized an ordinance amending Ordinance No. 19966, to add a sidewalk cafe on Munger Avenue right-of-way by Resolution No. 96-3054, Ordinance No. 22892.
