BACKGROUND

 

The City of Dallas has applied for and received Housing Opportunities for Persons with AIDS (“HOPWA”) funds since 1993 to support eligible activities within the Dallas Eligible Metropolitan Statistical Area (“Dallas EMSA”), which includes Dallas, Collin, Denton, Ellis, Hunt, Kaufman, and Rockwall counties.

 

The U.S. Department of Housing and Urban Development (“HUD”) provides grant funds through the HOPWA Program according to the terms of 24 C.F.R. Part 574, to assist grantees in meeting the housing needs of low-income persons with HIV/AIDS and HIV-related illness and their families.

 

The City is a grantee of HOPWA Funds to serve the Dallas EMSA (the “HOPWA Funds”), and on June 22, 2022, the City authorized final adoption of the FY 2022-23 HUD Consolidated Plan Budget, which included the HOPWA Grant Funds from HUD in the amount of $8,469,139.00, by Resolution No. 22-1024.

 

On April 8, 2022, the City issued a Request for Competitive Sealed Proposals (RFCSP) (#BRZ22-00018719) for HOPWA programs, consisting of (1) Emergency/Tenant Based Rental Assistance, (2) Facility Based Housing, Master Leasing, and Emergency Vouchers, (3) Housing Placement and Other Support Services, (4) Housing Facilities Rehabilitation/Repair, and (5) Housing Information Services, for persons living with HIV/AIDS.  Health Services of North Texas, Inc. (HSNT) submitted a proposal for Emergency/Tenant Based Rental Assistance, and was recommended for funding.

 

On February 22, 2023, the City Council authorized a one-year service contract, with two one-year renewal options contingent on available funding, with a term beginning on October 1, 2022, with HSNT for Emergency/Tenant Based Rental Assistance in the amount of $620,731.00, which amount included a ratified amount of $258,637.92, under the HOPWA program, and ratification for the Office of Community Care to pay outstanding invoices for services by Resolution No. 23-0318. 

 

On June 14, 2023, the City Council adopted the FY 2023-24 HUD Consolidated Plan Budget for HUD Grant Funds by Resolution No. 23-0765.  The FY 2023-24 HUD Consolidated Plan Budget included HOPWA Grant Funds in the amount of $9,604,613.00, which were available beginning October 1, 2023.

 

On September 13, 2023, the City Council authorized the first of two, one-year renewal options, to the contract with HSNT with a term beginning on October 1, 2023 through September 30,2024, for Emergency/Tenant Based Rental Assistance in an amount not to exceed $698,322.00, increasing the contract from $620,731.00 to $1,319,053.00, by Resolution No. 23-1231.

 

HSNT is a non-profit agency located in Denton, with offices also located in Plano, providing quality medical and support services to persons living with HIV/AIDS in the rural and outer urban communities of North Texas.  The agency was founded in 1988 and has been providing HOPWA scattered site housing assistance since 1996.  HSNT provides HOPWA assistance to persons living with HIV/AIDS residing primarily in the rural/suburban counties within the Dallas EMSA. 

 

Under the HOPWA Program, HSNT provides short-term emergency assistance and long-term tenant based rental assistance to low-income persons living with HIV/AIDS primarily in Collin, Denton, Hunt, Kaufman, and Rockwall counties. The Short-Term Rent, Mortgage, and Utility (STRMU) Assistance program includes short-term rent, mortgage, and utility payments, for up to 21 weeks in any 52-week period, to prevent the homelessness of the client.  The Tenant Based Rental Assistance (TBRA) Program includes rent assistance (with a utility allowance) similar to the Section 8 voucher program.  In addition to housing assistance, HOPWA clients also receive supportive services through case managers who ensure that clients have access to needed services.

 

HSNT notified the City of Dallas that, due to rising housing costs (particularly in Collin and Denton counties), the agency’s TBRA Program is projected to be overbudget, and is unable to sustain TBRA housing assistance for all 40 persons living with HIV/AIDS who are currently participating in the program. In lieu of terminating some or any program participant, staff recommends providing additional TBRA funding to allow HSNT to sustain TBRA assistance for those who are currently participating in the program. While it is currently projected that the additional funding will be needed to sustain the TBRA Program, if funds are projected to be left over by year end, HSNT would use any excess to provide additional STRMU assistance.

 

This agenda item authorizes Supplemental Agreement No. 2 to the contract with HSNT funded under the FY 2023-24 HUD Consolidated Plan Budget for HUD Grant Funds, to increase the contract amount by $150,000.00, to allow HSNT to sustain and continue housing assistance for persons living with HIV/AIDS.

On June 22, 2022, the City authorized final adoption of the FY 2022-23 HUD Consolidated Plan Budget, which included the HOPWA Grant Funds from HUD by Resolution No. 22-1024.

 

On February 22, 2023, the City Council authorized (1) one-year service contract(s), with two one-year renewal options, contingent on available funding, with a term beginning on October 1, 2022, approved as to form by the City Attorney, with subrecipients for Housing Opportunities for Persons with AIDS programs as follows: (a) Health Services of North Texas, Inc. for Emergency/Tenant Based Rental Assistance; (b) Open Arms, Inc. dba Bryan’s House for Housing Placement and Other Support Services (childcare services); (c) Legacy Counseling Center, Inc. for Facility Based Housing Services (Cottage); (d) Legacy Counseling Center, Inc. for Master Leasing/Emergency Voucher Services; (e) Legacy Counseling Center, Inc. for Housing Facilities Rehabilitation Services; and (f) Legacy Counseling Center, Inc. for Housing Information Services; (g) PWA Coalition of Dallas, Inc. dba AIDS Services of Dallas for Emergency/Tenant Based Rental Assistance and Housing Placement and Other Support Services (for permanent housing placement and short-term rent/mortgage/utility assistance services); (h) PWA Coalition of Dallas, Inc. dba AIDS Services of Dallas for Facility Based Housing, Master Leasing, and Emergency Voucher Services; and (i) PWA Coalition of Dallas, Inc. dba AIDS Services of Dallas for Housing Facilities Rehabilitation; and (2) ratification(s) for the Office of Community Care to pay outstanding invoices for services provided by the subrecipients by Resolution No. 23-0318.
