Authorize an agreement between the City of Dallas and the Regional Transportation Council (RTC) to (1) outline the roles and responsibilities of each party for the use of Metropolitan Planning Organization Transportation Development Credits (“TDCs”) for fifteen City of Dallas projects; and (2) accept the 8,915,616 TDCs awarded by RTC to be used in lieu of a local cash match to future federal funds for the fifteen projects - Financing: This item has no cost consideration to the City (see Fiscal Information)

BACKGROUND
The Regional Transportation Council (RTC) awarded 8,915,616 local and regional Transportation Development Credits (TDCs) to the City of Dallas to utilize for the projects identified in Exhibit A in lieu of the required local cash match for the federally funded transportation projects. Any unused TDCs shall be reallocated to other projects as solely determined by the RTC.
The use of federal funding requires a 20 percent local cash match, which will be satisfied by using 8,915,616 Metropolitan Transportation Plan TDCs for the fifteen projects. The projects will become 100 percent federally funded once TDCs are utilized.
A TDC is a Federal Highway Administration financing tool that allows states to use federal funding without the requirement of a cash match. These credits are non-cash credits allocated to states to account for toll road and tolled managed lanes that benefit the federal system. RTC awarded TDCs to the City of Dallas for its policies, programs, and projects that support regional 2045 Metropolitan Plan goals.
According to the Texas Administrative Code (43 TAC §5.110), agencies receiving TDCs from a Metropolitan Planning Organization (MPO) for a project must enter into an agreement with that MPO that outlines the terms of TDC use. The agreement between the City and RTC is needed for project inclusion in the Transportation Improvement Program (TIP). The TIP is the first step for review and approval for funding by the Texas Department of Transportation and the Federal Highway Administration.
This action will authorize an agreement between the City of Dallas and the RTC to (1) outline the roles and responsibilities of each party for the use of Metropolitan Transportation Plan TDCs for fifteen City of Dallas projects; and (2) accept the 8,915,616 TDCs awarded by RTC to be used in lieu of a local cash match to future federal funds for the fifteen projects.

FISCAL INFORMATION
This action has no cost consideration to the City. The total project cost of this agreement is $44,578,084.00 and encompasses the fifteen projects listed below. These projects are 100 percent federally funded; however, there will be future agenda items to accept the use of TDCs as a local match for federal funds.
