BACKGROUND

 

UPRR and the City of Dallas desire to improve the existing, at-grade crossing area along, over, and across UPRR's track and right-of-way at the Prairie Creek Road crossing and Sam Houston Road crossing. These crossings require additional safety improvements that are necessary to reestablish the Quiet Zone along the UPRR corridor that encompasses these crossings. UPRR will perform the work of construction observation and engineering, with the City agreeing to reimburse UPRR for those services.

 

The City agrees to reimburse UPRR for 100 percent of actual costs incurred by UPRR in connection with the work UPRR is performing. During the performance of the work, UPRR will provide progressive billing to the City based on UPRR’s actual costs. Within 120 days after completion of the Project, UPRR will submit a final billing to the City for any balance owed to UPRR in connection with the work performed by UPRR. The City shall pay UPRR within 30 days after receipt of any progressive and final bills submitted by UPRR.

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On June 14, 2023, the City Council authorized the Notice of Intent to establish a Quiet Zone along the UPRR corridor encompassing the Prairie Creek Road and Sam Houston Road crossings by Resolution No. 23-0785.

 

 

On August 23, 2023, the City Council authorized the Notice of Establishment for a Quiet Zone along the UPRR corridor encompassing the Prairie Creek Road and Sam Houston Road crossings by Resolution No. 23-1139.
