BACKGROUND

 

On July 6, 2021, the City of Dallas and Dallas County entered into a Master Agreement by Commissioners Court Order 2021-0697 for the purpose of transportation improvements on roads inside Dallas County. The City wishes to enter into a Funding Agreement (FA) with Dallas County for the purpose of constructing roadway improvements along Harry Hines Boulevard (Green Spine) from Inwood Road to East of Medical District Drive to include context sensitive elements to address ecological improvements and multimodal connectivity improvements that allow the safe, comfortable passage of automobiles, public transit, bicyclists, and pedestrians (MCIP Project No. 40234). The City has requested that it be designated as the Lead Agency for the Project and will provide the Project Manager.

 

 

 

 

On March 28, 2018, the City Council authorized a Memorandum of Understanding with the North Central Texas Council of Governments (NCTCOG) Regional Transportation Council (RTC) in which the RTC agreed to provide federal funding for six City of Dallas 2017 Bond Program projects that included this Project.

 

On August 10, 2022, the Texas Trees Foundation (TTF) entered a Development Participation Contract with the City of Dallas for the donation of privately funded design plans for this Project.

 

The current total Project cost estimate is $24,800,000.00 and includes $7,500,000.00 from the City of Dallas, $3,800,000.00 from TTF, $6,000,000.00 from NCTCOG, and $7,500,000.00 from Dallas County ($7,200,000.00 for construction and $300,000.00 for County in-house project delivery costs).

 

A contract for the construction and completion of the Project will be placed on a future City Council agenda for consideration.

 

This FA is to specifically identify the Project and any changes in the rights and responsibilities of each party as set forth in the Master Agreement. This FA will be an addition to the Master Agreement and incorporate each of its terms and conditions. All terms of the Master Agreement remain in full force and effect except as modified by the FA. In the event of any conflict between the Master Agreement and the FA, the FA will control specifically to the Project.

 

Chapter 791 of The Texas Government Code and Chapters 251 and 472 of the Texas Transportation Code provide authorization for local governments to contract with each other for the performance of governmental functions and services, as well as joint funding of road construction or improvements of road or street projects.

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On March 28, 2018, the City Council authorized a Memorandum of Understanding with the NCTCOG RTC stating the RTC will provide federal funding for six City of Dallas 2017 Bond Program projects that included $6,000,000.00 for the Harry Hines Boulevard Improvements project by Resolution No. 18-0440.

 

On August 10, 2022, the City Council authorized a Development Participation Contract with TTF for the donation of privately funded design plans for the Southwestern Medical District Streetscape Plan/Harry Hines Boulevard lmprovements project by Resolution No. 22-1090.
