Authorize the (1) Amendment No. 2 of the American Rescue Plan grant from the U.S. Environmental Protection Agency through the Texas Commission on Environmental Quality (TCEQ) (Contract No. 582-23-44419, Assistance Listing No. 66.034) to accept additional funding in the amount of $118,000.00, for replacement of aging equipment used by the City of Dallas to conduct ambient air monitoring, extending the term of the TCEQ contract from August 31, 2026 to August 31, 2027; (2) increase of appropriations in an amount not to exceed $118,000.00 from $137,942.00 to $255,942.00 in the TCEQ FY23-24 American Rescue Plan Fund; (3) receipt and deposit of funds in an amount not to exceed $118,000.00 in the TCEQ FY23-24 American Rescue Plan Fund; and (4) execution of the contract with TCEQ and all terms, conditions, and documents required by the agreement - Not to exceed $118,000.00 from $137,942.00 to $255,942.00 - Financing: TCEQ FY23-24 American Rescue Plan Fund

BACKGROUND
The Clean Air Act authorizes EPA to award non-competitive direct awards to state, local, and tribal air pollution control agencies to implement programs for the prevention and control of air pollution or implementation of the National Ambient Air Quality Standards. A key component of implementing these programs is the operation and maintenance of the regulatory ambient air monitoring network. The American Rescue Plan (ARP) provided much needed additional funding to upgrade and expand key components of the ambient air monitoring network. Consistent with the Clean Air Act, these funds were awarded non-competitively to state, local, and tribal air agencies to carry out this effort.
This action addresses Contract No. 582-23-404419 which adds additional funding as well as extends the contract period from August 31, 2026, to August 31, 2027, utilizing a one-year renewal to August 31, 2027, these funds will replace aging equipment utilizing the American Rescue Plan. TCEQ will reimburse the City of Dallas 100% of the costs associated with replacing current air-monitoring equipment.
PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)
On August 9, 2023, the City Council authorized Contract No. 582-23-44419 with the Texas Commission on Environmental Quality to receive funds as part of the American Rescue Plan (ARP) to replace aging equipment used by the City of Dallas to conduct ambient air monitoring. The effective date allowed for these funds is for the period February 1, 2023, through August 31, 2024, in an amount not to exceed $113,942.00; by Resolution No. 23-1947.
On August 14, 2024, the City Council authorized the first amendment to Contract No. 582-23-44419 with the Texas Commission on Environmental Quality to receive funds as part of the American Rescue Plan (ARP) to replace aging equipment used by the City of Dallas to conduct ambient air monitoring. The effective date allowed for these funds is for the period August 31, 2024, through August 31, 2026, in an amount not to exceed $118,000.00; and by Resolution No. 24-1092.
