Authorize an amendment to Resolution No. 21-0612, previously approved on April 14, 2021, for an Advance Funding Agreement with the Texas Department of Transportation (TxDOT) (Agreement No. CSJ 0918-47-281 and Right-of-Way Controlling Survey Job 0918-47-302, Assistance Listing No. 20.205) for costs related to the U.S. Route 75, Greenville Avenue, Lovers Lane, and Mockingbird Lane Project to (1) correct Section 4 of Resolution No. 21-0612, by amending the local match amount to be paid to TxDOT from $880,928.00 to $17,618.56; and (2) add a new Section 8 to Resolution No. 21-0612, to authorize disbursement of the $863,309.44 balance of the local match amount after the local match TxDOT amount has been authorized to be disbursed to TxDOT - Financing: This item has no cost consideration to the City (see Fiscal Information)

BACKGROUND
On April 14, 2021, the City Council authorized an Advance Funding Agreement with Texas Department of Transportation to accept a grant from the United States Department of Transportation Federal Highway Administration through the Texas Department of Transportation (TxDOT) for the Congestion Mitigation and Air Quality Improvement Program (Agreement No. CSJ 0918-47-281 and Right-of-Way (ROW) CSJ 0918-47-302, CFDA No. 20.205) in the amount of $3,453,238.00 as federal share in the total project cost of $4,599,748.00 (includes Federal and State participation of $3,718,820.00) for costs related to the preparation of preliminary engineering (design schematic, environmental documents/public involvement), plans, specifications and estimates, right-of-way acquisition, utility relocations, and construction of pedestrian improvements including traffic signals, sidewalks, crosswalks, lighting, and intersection improvements at various locations within the boundaries of U.S. (US) Route-75 to the west, Greenville Avenue to the east, Lovers Lane to the north, and Mockingbird Lane to the south in the City of Dallas; provide a local match in the amount of $880,928.00 from 2017 General Obligation Funds (the “Local Match Amount”); execute an Advanced Funding Agreement approved as to form by the City Attorney, with TxDOT in a total approximate amount of $4,599,748.00, and all terms, conditions, and documents required by the AFA; and issue warrant check payments to TxDOT in the amount of $17,618.00 as a portion of the local match (the “Local Match TxDOT Amount”) for the City’s share of TxDOT engineering review, right-of-way review and construction oversight cost, by Resolution No. 21-0612.
On April 12, 2023, the City Council authorized a professional engineering services contract with Kimley-Horn and Associates, Inc., to provide preliminary engineering services for pedestrian improvements within the boundaries of U.S. 75 on the west, Lovers Lane on the north, Greenville Avenue on the east, and Mockingbird Lane on the south, in an amount not to exceed $473,578.00, by Resolution No. 23-0465.
This action will amend Resolution No. 21-0612 to: (1) correct Section 4 of Resolution No. 21-0612, by amending the local match amount to be paid to TxDOT from $880,928.00 to $17,618.56; and (2) add a new Section to authorize disbursement of the $863,309.44 balance of the local match amount after the local match TxDOT amount has been authorized to be disbursed to TxDOT.

FISCAL INFORMATION
This action has no cost consideration to the City. The costs associated with this project were authorized in the previous City Council Resolution No. 21-0612; and the reduction in the Local Match to TxDOT will be addressed in an internal fiscal document.
