A public hearing to receive comments on a proposed municipal setting designation to prohibit the use of groundwater as potable water beneath properties owned by Baylor Scott & White Health and Dallas Area Rapid Transit (list attached to the Agenda Information Sheet) generally located along Haskell Avenue, Swiss Avenue, CBD Fair Park Link, and Elm Street and adjacent street rights-of-way; and an ordinance authorizing support of the issuance of a municipal setting designation to Baylor Scott & White Health by the Texas Commission on Environmental Quality and prohibiting the use of groundwater beneath the designated property as potable water - Financing: No cost consideration to the City

BACKGROUND
Based on information provided by the Applicant, the designated property is underlain by shallow groundwater that is encountered at approximately 5 to 20 feet below ground surface (bgs). A portion of the designated groundwater has been affected by chlorinated volatile organic compounds at concentrations above groundwater ingestion standards. The potential onsite and offsite sources in groundwater are historical dry-cleaning operations.
The applicant has requested that the City support its application for an MSD. A public meeting will be held on May 29, 2025 to receive comments and concerns. Notices of the meeting was sent to 2,787 property owners within 2,500 feet of the property and 72 private well owners within 5 miles of the property. There are no other municipalities within one-half mile of the property.
The designated property was entered into the Voluntary Cleanup Program (VCP) administered by the Texas Commission on Environmental Quality (TCEQ) on May 28, 2015 and is designated as VCP ID No. 2741.
This item is a municipal setting designation ordinance prohibiting the use of potable groundwater beneath properties generally located along Haskell Avenue, Swiss Avenue,
CBD Fair Park Link, and Elm Street including adjacent street rights-of-way; and supporting the issuance of an MSD by TCEQ.
The applicant’s current plan is to obtain closure through the VCP supported by an MSD. Currently the Designated Property is developed as commercial use including hospitals, medical offices, office buildings, distribution warehouses, hotel, retail establishments, restaurants, and rail station and corridors. The anticipated future use of the Designated Property will remain similar to the current use providing primarily medical, healthcare, and transportation services with potential redevelopment of individual parcels. The designated property also includes Dallas Fire Station No. 3 with anticipated future use expected to remain the same.
