Authorize an amendment to Resolution No. 24-1641, previously approved on November 13, 2024, authorizing an Advance Funding Agreement with the Texas Department of Transportation (Agreement No. CSJ 0918-47-376, Assistance Listing No. 20.205) for cost to implement bike lanes along Fair Oaks Avenue from Ridgecrest Road to Walnut Hill Lane, for the purpose of revising the project budget to increase state participation from $20,528.00 to $22,681.00, increasing the total project budget from $466,778.00 to $468,931.00 - Financing: No cost consideration to the City

BACKGROUND
On November 13, 2024, the City Council authorized an Advance Funding Agreement (AFA) with Texas Department of Transportation (TxDOT) to accept a grant from the U. S. Department of Transportation Federal Highway Administration through TxDOT for the Congestion Mitigation and Air Quality (CMAQ) Improvement Program (Agreement No. CSJ 0918-47-376, Assistance Listing No. 20.205) in the amount of $350,000.00 as federal share in the total project cost of $466,778.00, which includes $343,000.00 in federal reimbursement, $7,000.00 as federal participation for direct state cost, $20,528.00 as state participation for indirect state cost, and $96,250.00 ($85,750.00 for construction cost and $10,500.00 for direct state cost paid to TxDOT prior to construction) plus any cost overruns as local participation for costs to implement bike lanes along Fair Oaks Avenue from Ridgecrest Road to Walnut Hill Lane (“Project”) by Resolution No. 24-1641.
Prior to execution of the AFA, the project budget was revised to increase the state participation amount from $20,528.00 to $22,681.00, increasing the total project budget from $466,778.00 to $468,931.00. The amount of federal and local participation remains unchanged.
The Project is being funded with 80% federal sources and 20% local participation. TxDOT is contributing $343,000.00 in federal reimbursement, $7,000.00 as federal participation for direct state cost, and $22,681.00 as state participation for indirect state cost. The City’s participation is $96,250.00, which includes $85,750.00 for construction and $10,500.00 paid to TxDOT prior to construction for direct state cost. The total estimated project cost is $468,931.00.
If approved, this action will amend Resolution No. 24-1641, previously approved on November 13, 2024, to increase state participation in the project from $20,528.00 to $22,681.00, increasing the total project budget from $466,778.00 to $468,931.00.
