BACKGROUND

 

Dallas Homebuyer Assistance Program (DHAP) is the homebuyer assistance program offered by the City of Dallas and currently administered by the Office of Housing and Community Empowerment (OHCE) (formerly known as the Department of Housing & Community Development, referred to as “Housing”). DHAP is funded through both non-federal, including Tax Increment Financing (TIF) District Funds, and federal funding sources, including Community Development Block Grant (CDBG) program funds and HOME Improvement Partnerships Program (HOME) Funds, and adheres to all regulations of the U.S. Department of Housing and Urban Development (HUD), as well as state and City laws and regulations.

 

When using federal Funds, federal regulations permit the City, as a pass-through entity, to contract with a subrecipient to carry out a portion of the federal award on the City’s behalf. Outsourcing DHAP to a private entity will deliver services in a more streamlined manner.

 

On August 8, 2025, a non-formal evaluative procurement, which the City calls a Notice of Funding Availability (NOFA) was posted and received three responses. The applications were scored, and a four-member committee, comprised of staff from Housing & Community Development, Emergency Management & Crisis Response, Office of Homeless Solutions and the Office of Equity and Inclusion, reviewed and evaluated the qualifications of the proposals. The committee selected the applicant based on demonstrated competence, qualifications, financial capacity, staff and organizational experience, and workplan. Housing used its list serve to publicize the NOFA and posted it on the Housing website at www.dallashousingpolicy.com.

 

Business and Community Lenders of Texas dba BCL of Texas was selected as the subrecipient to enter into an agreement to provide homebuyer assistance to residents of Dallas.

 

This action will authorize the City Manager to execute a two-year agreement with two two-year renewal options, approved as to form by the City Attorney, with Business and Community Lenders of Texas dba BCL of Texas and/or its affiliate (Subrecipient) for DHAP administration, management, and implementation, pursuant to the Dallas Housing Resource Catalog (DHRC), the CDBG and HOME Improvement Partnerships Program (HOME) Regulations, and applicable federal, state, or local laws or regulations in an amount not to exceed $1,200,000.00.

 

While onboarding Business and Community Lenders of Texas dba BCL of Texas, OHCE staff will prioritize closing the remaining cases in the pipeline. Staff will also work with the Subrecipient to develop a timeline for the remainder of the fiscal year, define reporting metrics, and prepare for the launch of the next application period. BCL of Texas is expected to serve 25 residents with the funding currently available. Additional allocations of CDBG, HOME and/or TIF District Funds may be added through supplemental agreements or contract extensions as they become available.

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On April 12, 2023, the City Council adopted the Dallas Housing Policy 2033 (DHP33) to replace the Comprehensive Housing Policy (CHP) by Resolution No. 23-0443 and the Dallas Housing Resource Catalog (DHRC) to include the approved programs from the CHP by Resolution No. 23-0444.

 

On June 12, 2024, the City Council authorized final adoption of the City's Five-Year Consolidated Plan for FY 2024-25 through FY 2028-29 and the first FY 2024-25 Action Plan, with the FY 2024-25 HUD Consolidated Plan Budget in the amount of $30,949,109.00, by Resolution No. 24-0873.

 

On September 25, 2024, the City Council authorized funding transfers from the Oak Cliff Gateway TIF District, Fort Worth Avenue TIF District, and Deep Ellum TIF District (TIF Districts) to Housing to be deployed in the City’s homeowner stabilization, home repair, and displacement mitigation programs for the costs of providing and preserving affordable housing inside and outside of the TIF Districts by Resolution No. 24-1401.

On August 27, 2025, the City Council authorized preliminary adoption of Substantial Amendment No. 1 to the FY 20025-26 Action Plan Budget and a public hearing to be held on October 8, 2025, to receive public comments on the FY 2025-2026 Action Plan Budget by Resolution No. 25-1350.

 

The Community Development Commission was briefed on CDBG Timely Expenditure of Funds, which includes discussion on the DHAP service delivery model on October 9, 2025.

 

On December 10, 2025, the City Council repealed the DHP33, by Resolution No. 25-1895 and adopted the Drivers of Opportunity Policy Framework by Resolution No. 25-1836 to ensure continued equitable and legally compliant use of federal funds.

 

On December 10, 2025, the City Council approved an amendment to the Dallas Housing Resource Catalog to remove references to the DHP33, the Pillars of Housing Equity, and Equity Strategy Target Areas and to update department name to the Office of Housing and Community Empowerment.

 

On December 10, 2025, the City Council authorized final approval of Substantial Amendment No. 1 to the FY 2025-26 Action Plan Budget by Resolution No. 25-1927.

 

The Housing and Homelessness Solutions Committee was briefed on the vendor selection on February 10, 2026.

 

On February 25, 2026, the City Council will consider an amendment to revise the Dallas Homebuyer Assistance Program (DHAP) in the DHRC.
