Authorize Contract Amendment No. 1 to the construction services contract with XIT Paving & Construction, Inc. for the construction of the Five Mile Infrastructure Improvements Package A Project to increase the contract amount in the amount of $842,353.00 (list attached to the Agenda Information Sheet) - Not to exceed $842,353.00, from $11,564,976.75 to $12,407,329.75 - Financing: Wastewater Construction Fund ($115,880.00), Water Construction Fund ($232,793.00), and 2024B Certificates of Obligation Fund ($493,680.00)

BACKGROUND
On February 28, 2024, the City Council authorized the construction services contract with XIT Paving & Construction, Inc. for Five Mile Infrastructure Improvements Package A Project by Resolution No. 24-0327.
The scope of work includes replacing the existing deteriorating streets with reinforced concrete pavement, curb and gutter, sidewalk, driveway approaches, drainage improvements, water and wastewater improvements, illumination, and other miscellaneous items necessary to complete the project, in accordance with plans and specifications.
Due to the delays in securing the United States Housing and Urban Development (HUD) Environmental Clearance and Right-Of-Way and Easement acquisition, the project could not begin as scheduled. Consequently, the contractor, XIT Paving & Construction, Inc. requested additional funding in the amount of $842,353.00 to cover the price inflation in construction materials, equipment, and labor.
This action will authorize Contract Amendment No. 1 to the construction services contract with XIT Paving & Construction, Inc. for the additional funding needed to complete the Five Mile Infrastructure Improvements Package A Project.

On June 9, 2021, the City Council authorized the adoption of the FY 2021-22 Consolidated Plan Budget, by Resolution No. 21-0974.
On June 22, 2022, the City Council authorized the adoption of the FY 2022-23 Consolidated Plan Budget, by Resolution No. 22-1024.
On June 14, 2023, the City Council authorized the adoption of the FY 2023-24 Consolidated Plan Budget, by Resolution No. 23-0765.
On February 28, 2024, the City Council authorized the construction services contract XIT Paving & Construction, Inc. for Five Mile Infrastructure Improvements Package A project in the amount of $11,564,976.75 by Resolution No. 24-0327.
