BACKGROUND

 

On June 24, 2020, City Council authorized a (1) preliminary adoption of Substantial Amendment No. 4 to the FY 2019-20 Action Plan for the Home Improvement and Preservation Program funded by Community Development Block Grant funds (CDBG) to amend the rehabilitation loan program to increase the maximum loan amount from $40,000.00 to $50,000.00 and to change the loan terms from repayable to forgivable annually; and (2) public hearing to be held on August 12, 2020, to receive comments on Substantial Amendment No. 4 to the FY 2019-20 Action Plan.

 

On June 12, 2019, City Council authorized the FY 2019-20 through FY 2023-24 Five-Year Consolidated Plan and the FY 2019-20 Annual Action Plan for U.S. Department of Housing and Urban Development (HUD) programs including the CDBG, HOME Investment Partnerships Program Grant (HOME), Emergency Solutions Grant (ESG), and Housing Opportunities for Persons with AIDS Grant (HOPWA). The Action Plan provides a detailed description of programs and services to be undertaken with the grant funds over the twelve-month period of October 1, 2019 through September 30, 2020, to address priority needs in the community designed to improve Dallas residents’ quality of life for low- and moderate- income persons.

 

In early 2020, City Council authorized Substantial Amendment No. 1 to terminate the CDBG Revolving Loan Fund Program and Substantial Amendment No. 2 to extend and reprogram CDBG funds to support the Residential Development Acquisition Loan Program and the Vickery Meadow Community Court.

 

The City of Dallas now proposes to revise one existing activity currently in the original FY 2019-20 Action Plan, the Home Improvement and Preservation Program (HIPP), an activity to provide home repair opportunities to low- and moderate-income persons.

 

Federal regulations and the City’s revised Citizen Participation Plan require a public hearing to authorize a substantial amendment and require that a public hearing be held with not less than a 5-day public review and comment period to allow for public comments and input with respect to any substantial amendment. The reduction to a 5-day public comment period is due to HUD’s waiver of the 30-day public comment period as a result of the Coronavirus pandemic.

 

This action will authorize a public hearing for Substantial Amendment No. 4 to the FY 2019-20 Action Plan, and at close of the public hearing, authorize revisions to the HIPP funded by CDBG program statement, as detailed above.

 

PRIOR ACTION/REVIEW (COUNCIL, BOARDS, COMMISSIONS)

 

On June 12, 2019, City Council approved the FY 2019-20 through FY 2023-24 Five-Year Consolidated Plan and the FY 2019-20 Annual Action Plan for U.S. HUD grant programs including the CDBG, HOME, ESG, and HOPWA Grants by Resolution No. 19-0886.

 

On June 26, 2019, City Council held a public hearing to receive comments on Substantial Amendment No. 2 to the FY 2018-19 Action Plan for the HOME and CDBG, to (a) revise the Dallas Homebuyer Assistance Program Statement to amend the area median income (AMI) requirements, to change the loan terms to forgivable annually, and to remove the Homebuyer Incentive Program; and (b) revise the HIPP program statement to amend the AMI requirements, to remove the accessibility grant program, add the Minor Home Repair Grant Program, and add the Housing Reconstruction Program; and at the close of the public hearing, authorized the final adoption of Substantial Amendment No. 2 to the FY 2018-19 Action Plan by Resolution No. 19-1061.

 

On January 22, 2020, City Council authorized the final adoption of Substantial Amendment No. 1 to the FY 2019-20 Action Plan for the CDBG Business Revolving Loan Program by Resolution No. 20-0235.

 

On February 26, 2020, City Council authorized final adoption of Reprogramming Budget No. 1 (Substantial Amendment No. 2) to the FY 2019-20 Action Plan by Resolution No. 20-0395.

 

On April 22, 2020, City Council authorized final adoption of: the FY 2020-21 HUD Consolidated Plan Budget;  the CARES Act Relief Funds Budget, No. 1 from HUD; the FY 2019-20 Substantial Amendment No. 3/Reprogramming Budget No. 2; and an amendment to the City’s Citizen Participation Plan to be consistent with expedited procedures for public review and comment period provided in the CARES Act, from no less than 30 days to no less than five days by Resolution No. 20-0655.

 

On June 24, 2020, City Council authorized (1) a preliminary adoption of Substantial Amendment No. 4 to the FY 2019-20 Action Plan for the HIPP funded by CDBG funds to amend the rehabilitation loan program to increase the maximum loan amount from $40,000.00 to $50,000.00 and to change the loan terms from repayable to forgivable annually; and (2) public hearing to be held on August 12, 2020, to receive comments on Substantial Amendment No. 4 to the FY 2019-20 Action Plan by Resolution No. 20-0972.

 

The Housing and Homelessness Solutions Committee was briefed regarding this matter on June 22, 2020.
