Authorize a decrease in the construction services contract with EAR Telecommunications, LLC dba EARTC to de-scope all traffic signal work associated with the intersection of Whitehurst Way and Ferris Branch Boulevard due to the intersection no longer meeting federal warrant requirements for a signalized intersection, including all associated quantities for that intersection - Not to exceed ($409,984.00), from $809,580.00 to $399,596.00 - Financing: Street and Transportation (A) Fund (2024 General Obligation Bond Fund)

BACKGROUND
On June 14, 2017, the City Council authorized a professional services contract with Kimley-Horn and Associates, Inc. for traffic signal design services of 75 traffic signals at various intersections and other related tasks, in an amount not to exceed $1,702,600.00, by Resolution No. 17-0931.
On September 24, 2025, the City Council authorized a construction services contract with EAR Telecommunications, LLC DBA: EARTC for the 2024 Bond Traffic Signal Construction - Group 4 Project to construct two new traffic signals at the intersections of McCree Road at Plano Road and Whitehurst Way at Ferris Branch Boulevard, in an amount not to exceed $809,580.00, by Resolution No. 25-1553.
The City became aware of the closure of a nearby school and completed a review of the traffic signal improvements included in the 2024 Bond Traffic Signal Construction - Group 4 project - McCree Road at Plano Road and Whitehurst Way at Ferris Branch Boulevard. Due to the closure of the school near the intersection of Whitehurst Way and Ferris Branch Boulevard, applicable federal warrant requirements established in the Manual on Uniform Traffic Control Devices no longer apply. As a result, construction of this traffic signal is no longer eligible to proceed as part of the project.
The proposed change order will remove all work items directly related to the installation of the traffic signal while maintaining the remainder of the contract work, including the total allotment of 210 working days for the project.
This action will authorize Change Order No. 1 to the construction services contract with EAR Telecommunications, LLC dba EARTC, to de-scope all traffic signal work associated with the intersection of Whitehurst Way and Ferris Branch Boulevard due to the intersection no longer meeting federal warrant requirements for a signalized intersection, including all associated quantities for that intersection, in an amount not to exceed ($409,984.00), decreasing the original contract from $809,580.00 to $399,596.00.
