BACKGROUND

 

On July 6, 2021, the City of Dallas and Dallas County entered into a Master Agreement by Commissioners Court Order 2021-0697 for the purpose of transportation improvements on roads inside Dallas County. The City wishes to enter into a Project Specific Agreement (PSA) with Dallas County constructing transportation improvements on Ross Avenue, from US 75 to Greenville Avenue, Major Capital Improvement Project No. 20226 (“Project”).

 

 

 

On September 22, 2021, the City Council authorized a professional engineering services contract to design a shared use path along Ross Avenue from Greenville Avenue to Interstate Highway 345 to Criado & Associates, Inc., in an amount not to exceed $740,204.44, by Resolution No. 21-1541.

 

On April 13, 2022, the City Council authorized acceptance of a grant from the United States Department of Transportation Federal Highway Administration through the Texas Department of Transportation (TxDOT) for a Transportation Alternatives Set-Aside (TASA) Program Grant (Agreement No. CSJ 0918-47-325, CFDA No. 20.205) in the amount of $3,836,092.00 as federal share in the total project cost of $4,037,312.43 (Federal share $3,836,092.00, Indirect State $166,346.93, and Direct State Participation $34,873.50 totaling $4,037,312.43) for costs related to construction of roadway improvements along Ross Avenue from North Central Expressway (IH345) to Greenville Avenue to accommodate a shared-use path, restripe pavement to accommodate four through lanes from IH345 to the Ross Avenue and Greenville Avenue intersection to include intersection improvements such as new ramps at signalized intersections, by Resolution No. 22-0548.

 

On November 24, 2023, the City Manager authorized Supplemental Agreement No. 1 to the Engineering Services Contract with Criado & Associates, Inc., to add additional scope that is required to fulfill the PS&E and design requirements associated with the project as outlined in the Supplemental Proposal for an increase to the contract in the amount of $66,140.00, increasing the original contract amount from $740,204.44 to $806,344.44, and extend the term of the agreement for an additional year from December 31,2023 to December 31,2024, by Administrative Action No. 23-6625.

 

On December 10, 2024, the City Manager authorized Supplemental Agreement No. 2 to the Engineering Services Contract with Criado & Associates, Inc., to extend the term of the agreement for an additional three months from December 31, 2024 to March 31, 2025, by Administrative Action No. 24-6588.

 

On January 22, 2025, the City Council authorized Supplemental Agreement No. 3 to the professional engineering services contract with Criado & Associates, LLC, formerly known as Criado & Associates, Inc. to (1) provide additional design services for Phase II of the project covering paving, drainage, water, and wastewater to accommodate a shared use path and intersection improvements along Ross Avenue between Greenville Avenue and Interstate Highway 345; and (2) extend the contract term by two years, for the period March 31, 2025 through March 31, 2027, in an amount not to exceed $1,464,419.92, from $806,344.44 to $2,270,764.36, by Resolution No. 25-0209.

 

On March 25, 2026, the City Council authorized Amendment No. 1 to the Advance Funding Agreement (AFA) (Agreement No. CSJ 0918-47-325, Assistance Listing No. 20.205) between the City of Dallas and the Texas Department of Transportation for a Transportation Alternatives Set-Aside (TASA) Program Project for costs related to construction improvements on Ross Avenue from Greenville to Interstate Highway 345 in the City of Dallas  increasing the federal participation from $3,836,092.00 to $5,700,000.00, by Council Resolution 26-0532.

 

The total estimated Project cost is $24,125,000.00 and is being funded from a combination of County ($3,500,000.00 (less $50,000.00 for in-house delivery)), Federal ($5,700,000.00), and City funding sources ($2,220,764.36 - previous actions and $12,704,235.64 - this item). This PSA is to specifically identify the Project changes in the rights and responsibilities of each party as set forth in the Master Agreement. This PSA will be an addition to the Master Agreement and incorporate each of its terms and conditions. All terms of the Master Agreement remain in full force and effect except as modified by the PSA. In the event of any conflict between the Master Agreement and the PSA, the PSA will control the Project specifically.

 

This action will authorize the increased appropriation and receipt and deposit of the Dallas County’s participation amount of $3,450,000.00. The amount associated with this agenda item, $16,154,235.64, includes the County portion, and future City Council action for the remaining balance of the total project costs that have not been authorized previously by council resolution or administrative action. Future agenda items will be brought to the City Council to authorize appropriations and disbursement of the remaining City participation balance of $12,704,235.64 from the Street and Transportation (A) Fund ($600,000.00), General Fund ($7,154,235.64), Water Capital Improvement G Fund ($3,366,329.00), Water Construction Fud ($50,000.00); Wastewater Capital Improvement G Fund ($1,517,156.00), and Wastewater Construction Fund ($16,515.00).

 

Chapter 791 of The Texas Government Code and Chapters 251 and 472 of the Texas Transportation Code provide authorization for local governments to contract with each other for the performance of governmental functions and services, as well as joint funding of road construction or improvements of road or street projects.
