An ordinance amending Chapter 51A, “Dallas Development Code: Ordinance No. 19455, as amended,” of the Dallas City Code by amending Section 51A-11.401; “Sunset Provision”; (1) providing a new sunset date; (2) providing a penalty not to exceed $2,000.00; (3) providing a saving clause; (4) providing a severability clause; and (5) providing an effect date - Estimated Revenue Foregone: General Fund ($4,019,087.00) and Debit Service Fund ($1,512,775.00), both over a five-year period

BACKGROUND
The Historic Preservation Tax Exemption Program (Ordinance No. 21874) was adopted by City Council in October 1993 and was subsequently amended in 1998, 2001, 2004, 2007, and 2015. The previous sunset provision was extended in 2020 for five years.
The Sunset Provision in Sec. 51A-11.401 of the Dallas City Code stipulates that no certificates of eligibility may be granted, and no applications for extension of the deadline for rehabilitation or deadline for a certificate of occupancy may be considered, by the Landmark Commission after December 31, 2025.
On December 1, 2025, a briefing memorandum pertaining to the Historic Preservation Tax Exemption Sunset will be included on the agenda of the Economic Development Committee.
