BACKGROUND

Chapter 372 of the Texas Local Government Code ("Act") allows for the creation of public improvement districts ("PIDs"). The RedBird Public Improvement District ("District") was created by the City Council on May 28, 2025 in accordance with the Act by Resolution No. 25-0872. On August 27, 2025, by Resolution No. 25-1408, the City Council designated Red Bird Public Improvement District Inc. ("RBPIDI") as the manager of the District and authorized a management agreement with RBPIDI to be funded from special assessments on taxable property in the District.

In addition to that ongoing management agreement funded from special assessments on taxable property in the District, this agreement now before City Council is a separate and distinct agreement with RBPIDI and is proposed to be funded solely by a discretionary allocation of City Council District 3 ARPA Redevelopment Fund dollars.
