BACKGROUND

The City of Duncanville (Duncanville) is located within Dallas Water Utilities' (DWU) service area and currently purchases wholesale treated water from the City of Dallas (Dallas) since 1984. Duncanville and Dallas entered into a 30-year Wholesale Treated Water Contract and Reciprocal Water and/or Wastewater Agreement on October 1, 2014 through September 30, 2044.

In 2020, Duncanville awarded a design-build contract for the street reconstruction project of East Danieldale Road within the city limits of Duncanville between South Main Street and State Highway 67, which is in the vicinity of a Dallas 54-inch water transmission main and a 16-inch water redundancy main. These utilities mains provide water to Duncanville through the current Wholesale Services contract with DWU. Dallas was not involved in the preliminary planning and design phases of this project.

During construction, Duncanville identified an existing structurally deficient retaining wall on East Danieldale Road which was directly adjacent to a Dallas 16-inch water main. It was determined that the retaining wall must either be rehabilitated or demolished and replaced. Both options involved the use of heavy machinery above the 16-inch water main, which could potentially damage the main and/or cause property damage to residential structures approximately 10 to 20 linear feet from the retaining wall.
